  • The aspiration for getting new heights for  protecting and safeguarding the railwy passengers and their belongings by the RPF with new amendment to the proposed RPF Amendment has gone to the winds and kept in cold-storage almost forever with the States' opposition to any such move and pointed about the powers,status,authority and the lot enumerated in the Indian Constitution, the Articles, the Schedules, the Law etc,. And the Government to keep the State's in line with them sidelined the matter;
  • Amid a controversy brewing over the proposed amendment to the Railway Protection Force Act, 1957, with a number of states ruled by non-UPA parties raising objections, Railway Minister Dinesh Trivedi said on Wednesday the amendment would not take place if states were against it.
  • But, even today , I am not in a position to understand as to how and why the Central government and the ministry of Railways, the Legal Professional Experts from the Centre/the States, and the Private have kept quite all these days about upcoming of the HMR- Hyderabad Metro Railways Project Works, now in full swing, first given to Satyam and then to the L&T, until,till recently when the Hon'ble High Court of Andhra Pradesh, Hyderabad in a Writ Petition found to have given 'Stay Orders' to the Metro Railways Project Works with very touching comments on its working pattern taken up by the State in the name of its Municipal Tramways Act, when the HMR itself was a full pledged Railways Work, and that the HMR first started its Works in a hurried way and met its end, and now again taken up. You can go through the news appeared in the daily news of the'Hindu' of Hyderabad Edition of 17th Mar,2012. But, the same throughts have been vehemently oppposed by the States toward the RPF when the act  was meant to protect and safeguard the safety and security of the railway passengers and their belongings by giving more powers to the RPF through  amendment in the Parliament: Dula system of thoughts and methodologies-likes and dislikes might be the criteria:
  • "The earth is enjoyed by heroes- this is the unfailing truth; be a Hero. Always say' I have no fear'. Tell this to everybody--'Have no fear; fear is death, fear is sin, fear is hell, fear is unrighteousness, fear is wrong life. All the negative thoughts and ideas that are in this world have proceeded from this evil spirit of fear...” Hence, act and make others to act with fearlessness, God shall see that the wicked, the vice, and the corrupt minded persons to perish once for all. Hence be Brave....Do not engulf yourself in vicious circle at any cost... let you be poor but be honest, sincere and with duty mindedness and exhibit your integrity not for appreciation, rewards or medals. To the point always and all the time be honest to the work, to the words and action....Your reward shall be your Honesty, you may be requiring some money to clear of the loans, to run the family, or children’s education and what not, but still be honest; check and discuss with you inner mind ; it shall tell how dishonest you are and your wife  nor your children does not share your sin, ill gotten money, they just enjoy as long as they can. Just see around all others may wish you but heart and heart they hate you and talk about your corrupt practices, may be in your absence. Hence do not let your life go in that line…A fact is always a fact that remains for ever whether you agree or not; I wish you shall not succumb to your monthly wants or require money to clear off your loans and for spendthrift , but still do not go for white collar crimes, or to work under some white collar criminal minded persons who may at this juncture pay you a lot and utilize your services and full fill their wants by using you in all means, but once you are spotted in some bad thing , that is all they shall make you the (e) scapegoat and try by all means to finish you and wash their hands.
  •  The authority in power has to analyze as to how and why it is- the corrupt practices, corruption, white collar crimes, living and surviving from within itself, and why it is even withstanding the pressures of the society; why the Law enforcement agencies are unable to tackle it effectively and efficiently; why it is grooming forward with out any sudden death or ineffectiveness. For all these questions and problems, sincere and honest answers are its solution.
  •          Bring the honest top officials to the fore front, including that of the politicians, who can very candidly say no to corrupt practices and must be in apposition to tackle the corrupt officials with iron hand and by-passing or sidelining the matters to next incumbent or to see that he survive for the seasoning and next elections by suppressing the matters under his fold.. Change the pattern of selection of the top brass and other designated jobs. 
  • It is my opinion to select sincere, good, and efficient personalities from all fields including the public and private industries; make coordinated committees; the chartered accountants, the doctors, the engineers, the bank officials are the officials who can also lay hand and curb this menace at the beginning. There shall be a separate department by itself.
  • II:

  • Why, then CBI should come in for the Investigation, when the Army is found  be having its own Laws, the Rules, and like authority of 'Court of Inquiry';its own Intelligence System;'Court Martial,etc; Why there shall be such hurried leak out of bribe offer by the Highest Official at the crucial time when HE-as the General could have at the spot brought the matter to the Notice of the Concerned Ministry/(er) in writing or Ordered for a probe when HE smelt of White Collar Criminality in the Vehicle's supply order,etc.; Why HE should keep quite all these days and burst out in public -interviews at a later stage, might be only to get popularized in a way or the other; Just informing that he had brought out this matter to the Notice of the Defence Minister does not found to be a good act of his covering up of HIS keeping quite /suppressing of acts against another Subordinate Officer,that too, after his retirement; Can any personnel shall take up this type of allegations in a later stage?

  • Take the case of the Centre's magnanimity and mind thought by not opposing or not disturbing, extending its support to the  Andhra Pradesh State in formulating the HMR - Metro Railway Project Work, exclusively taken up by the AP State Government and without any intervention by the Centre or by the Ministry of Railways, even though any Project Work concerning on the Railways or the Metro Railways has to be done in accordance with the provisions of the Metro Railway Acts, the Constitutional Powers, Schedules, the Articles thereon.(***but now the States are viewing otherwise for NCTC or in case of RPF getting police powers; The A.P. State passed A P Tramways Act and applying it for Metro Railways construction, without even a discussion in the Parliament about the Metro Railways Works taken up exclusively by the State; no where found to have taken the Metro Railways Acts, Constitutional Powers, etc, or the Ministry of Railways taking up the matter as like in Delhi, DMR now one of the Railway's Zone; we are in such state of affairs, no opposition for such action by ...????, who shall oppose, they are not… the Centre is nodding for its continuance; why not then for others to take the lead???***)  RPF powers through Parliament, Bill, etc. THIS IS WITH A VIEW TO EASE THE STATES OF THEIR EXTRA BURDEN OF SPENDING OF 50% OF EXPENDITURE ON THE GOVERNMENT RAILWAY POLICE EVEN THE CENTRE WANTED FOR THE SAFETY AND SECURITY OF THE RAILWAY PASSENGERS AND THEIR BELONGINGS UPHOLD THE VIEWS AND VISION OF THE FORMER HON'BLE PRESIDENT OF INDIA- MR.ABDUL KALAM EXPRESSED IN 2006...

All news about RPF- Trivedi’s statement comes on a day his party colleague, senior Trinamool Congress MP and Union Minister of State for Tourism Sultan Ahmed, said the RPF amendment was a “good move” meant to make railway security stronger. “The issue (of RPF and GRP dual policing system in the Railways) is a long standing one. There should be a uniform force for better protection of passengers. The RPF needs to be strengthened,” Ahmed said.
He said this was not similar to the issue of the proposed National Counter-Terrorism Centre, which the Trinamool feels is an attack on the country’s federal structure. “This issue should not be mixed with that of the NCTC, which is a completely different subject,” he said, and suggested that the Centre, and Trivedi in particular, should initiate a dialogue with the states on the RPF amendment issue.
Earlier in the day, the Congress had sought to distance itself from the RPF issue with party spokesman Manish Tewari saying the opposing states should direct their queries to the Railway Ministry. “Fact remains that if somebody has a problem with the amendments in the RPF Act, since the Railways is the nodal ministry, it should perhaps be appropriate to take it up with them,” he had said.
For empowering the RPF with legal powers to tackle all cognizable offences under the Indian Penal Code (IPC) and Special Acts so that there is a single point of responsibility for tackling crimes against railway passengers, the Central Government, after 60 years of independence, found to have made out a way and solution for the safety and security of the railway passengers and their belongings. In this connection as a reference-kindly go through the Articles published in monthly Magazine" Indian Railways"-PRESIDENT OF INDIA PRESENTS PRESIDENTIAL COLOURS TO RAILWAY PROTECTION FORCE JULY 2006); and, V.Seshadri’s -Article - “(THE MISSING DIMENSIONS ON SECURITY AND SAFETY OF PASSENGER-A POINT OF VIEW-JUNE-2007) . From the above it can be seen that the views and vision of Former Hon’ble President of India had paved the way for reconciliation on this matter and the Committee (the 14th Lok Sabha, date 8-12-2009 also made recommendations for more powers to RPF…
There shall be a day, in future, which is still awaited and eager to celebrate over the Railway's System when there can be only one Police Force and not TWO as we see today and have a unified single ‘Uniformed Indian Railway Police Force- exclusively for the Indian Railways System’ to deal all the matters of ‘railway property, passenger area, and passengers, and the matters connected there with. The Centre found to have taken decision to table Draft Bill in this connection in this Parliament Session:
Why THERE shall be so much opposition by the State Governments when the Centre is trying to uphold the rights of the citizens by formulating NCTC or making proposals for RPF empowering with Police Powers.. They shall have to feel happy that one more FORCE-RPF is coming to their and not taking away their powers

(I): There is much opposition by the State Governments when the Centre is trying to uphold the rights of the citizens, and to protect them by formulating NCTC or making proposals for RPF empowering with Police Powers.. They shall have to feel happy that one more FORCE-RPF is coming to their/State's assistance and not taking away their powers. Take the case of the Centre's magnanimity and mind thought by not opposing or not disturbing, extending its support to the Andhra Pradesh State in formulating the HMR - Metro Railway Project Work, exclusively taken up by the AP State Government and without any intervention by the Centre or by the Ministry of Railways, even though any Project Work concerning on the Railways or the Metro Railways has to be done in accordance with the provisions of the Metro Railway Acts, the Constitutional Powers, Schedules, the Articles thereon. One shall have recognizable definitions and the meanings, the deferential equations and other matters of the Tramways and the Metro Railways; At least now , the States must rethink in broad prospective like that of the Centre in the AP Ste taking up the Metro Railways Works of their own, with prospective open mind and positive thinking heartily support the Centre for RPF powers through Parliament, Bill, etc. THIS IS WITH A VIEW TO EASE THE STATES OF THEIR EXTRA BURDEN OF SPENDING OF 50% OF EXPENDITURE ON THE GOVERNMENT RAILWAY POLICE EVEN THE CENTRE WANTED FOR THE SAFETY AND SECURITY OF THE RAILWAY PASSENGERS AND THEIR BELONGINGS UPHOLD THE VIEWS AND VISION OF THE FORMER HON'BLE PRESIDENT OF INDIA- MR.ABDUL KALAM EXPRESSED IN 2006... 
(II):FOR THE LAST FIVE AND MORE decades, THE SAME SYSTEM OF LAW& order AND Crime GOES ON OVER THE INDIAN RAILWAYS, WHOEVER MAY THE THE MINISTER , THE FATE OF THE RAILWAY PASSENGER GOES ON AS IT WAS CAUGHT IN BETWEEN THE RPF AND GRP- PROMISINGLY/presciently BETWEEN THE STATES AND THE CENTRE ON POWER, ETC.. SHARING...DIVISION OF RESPONSIBILITY BETWEEN THE RPF AND THE GRP-VIS-À-VIS RAILWAY PROPERTY, PASSENGER AREA AND THE PASSENGERS OVER INDIAN RAILWAYS SYSTEM: 
: The Preamble of the RPF Act, envisaged that the RPF is constituted and maintained for the better protection and security of railway property, passenger area and passengers and for matters connected therewith. Likewise, the Preamble of the RP (UP) Act does state –‘an Act to consolidate and amend the law relating to unlawful possession of railway property. By this, it confines its parameters to that of ‘railway property’ alone as defined in the Law. The ‘railway property’ definition nevertheless does not include ‘the passenger area and passengers’ or ‘the offence(s) committed and/or connected therewith’. It may be observed that as contained in section 3 of the RPF Act, that the RPF is constituted and maintained for better protection and security of railway property. 
By this exclusion of specific and desired words ‘passenger area and passengers’, from within the section 3, the ambit and scope of the RPF has been substantially curtailed and in my considered opinion there are no authority and powers to deal any of the cases falling within the meaning of passenger area and passengers or their belongings, like theft of passenger’s luggage, assaults and other offences falling within the IPC section ,and emphatically, even if they (RPF) apprehend any culprit or recover such property belonging to the Passengers, in the course of their duties, they have to, invariably, forward the case to the GRP (Government Railway Police) with their Report for further necessary action ( Case registration/FIR, and Investigation ).
This excludes the RPF from registration of any FIR even if they detect such type of cases. Thus, the very purpose, proposed /for ‘better protection and security’ of the passenger area and passengers’ as expected by the Legislation is found to have been defeated. At the most the RPF is to be treated as the Assisting Force of the GRP.
In this context, to make rail journey safer and secure to the 12 million people including the tourists who are making use of the rail services every day, one shall not forget the speech and the vision of the (Former) Honourable President of India, Dr. A. P.J. Abdul Kalam while presenting President's Colours to the RPF on 22nd May, 2006 containing certain valuable observations and suggestions to the, Government of India, the Ministry of Railways, the Railway Board, the RPF, which include:

THIS is only in view of growing and uncontrolled/uncontrollable trends in the terrorism/Naxalism and crime in the trains/railway premises against the railway passengers and their belongings while traveling in the train or while on railway premises. They shall have to feel happy that one more FORCE-RPF is coming to their and not taking away their powers. Take the case of the Centre's magnanimity and mind thought by not opposing or not disturbing and extending its support to the Andhra Pradesh State in formulating the HMR - Metro Railway Project Work, exclusively taken up by the AP State Government and without any intervention by the Centre or by the Ministry of Railways, even though any Project Work concerning on the Railways or the Metro Railways has to be done in accordance with the provisions of the Metro Railway Act, the Constitutional Powers, Schedules, the Articles thereon and express sanction of the Parliament like in the Delhi Metro Railways Work, etc. and/or as per the Metro Railway Act and not otherwise...but , still, the Centre/the Ministry of Railways never intervened in AP State owning the Metro Railway's Project Works which in offing; they may also take up Tramways later in the city. Then why the States are hampering the Centre's proposal to equip the RPF with Police Powers, that too through Parliament, Bill, etc. THIS IS WITH A VIEW TO EASE THE STATES OF THEIR EXTRA BURDEN OF SPENDING OF 50% OF EXPENDITURE ON THE GOVERNMENT RAILWAY POLICE (THE REMAINING 50% IS MET BY THE CENTRE/THE MINISTRY OF RAILWAYS). THIS IS IN ADDITION TO GIVING ACCOMMODATION TO THE GRP, ETC...
EVEN THE CENTRE WANTED FOR THE SAFETY AND SECURITY OF THE RAILWAY PASSENGERS AND THEIR BELONGINGS AND NOT OTHERWISE.. LET THE CHIEF MINISTERS RE-THINK ON THE ISSUE WITH BROAD PROSPECTIVE AND I PRAY TO SUPPORT THE CAUSE OF THE CENTRE FOR SAME OF THE RAILWAY PASSENGERS, THE CITIZENS OF INDIA AND TOURISTS FROM OTHER COUNTRIES AND UPHOLD THE VIEWS AND VISION OF THE FORMER HON'BLE PRESIDENT OF INDIA- MR.ABDUL KALAM EXPRESSED IN 2006...
