At the outset I
would like to thank the AIRPFROWA for
taking unanimous decision to allow and giving liberty to the RPF pensioners to
form their own Associations’ to achieve their goals and objectives. In this
direction only, the RPF Pensioner’s Welfare Assn, SCRly, with head quarters SC
has been formed and registered vide No.1126/2012. The office bearers and all
the members convey our thanks for extending support to us.
We have taken up issues pertaining
to the RPF pensioner’s such as:
1).
Payment of FMA-As per recent Orders of the Railway, the PSA- Divisional/ Hqs.
In charge from where the pensioner retired-Pension Sanctioning Authority has to
ACCORD SANCTION for payment of monthly FMA and its arrears from the dated of
retirement on the Claimant’s ‘self Declaration Form’ as provided by the Railway
Board, then the PPO issuing authority shall forward the same to the PDA/or to
the CPPC of the concerned Band for payment of FMA;
2).Issue
of corresponding Comp. Pass to the RPF Pensioners who are in the grade of
4200/- and above, in spite of clear Orders from the Railway Board, the same
being rejected by RPF authorities over S.C.Rly. They are still seeking further
clarification from the CPO/SCR, SC, even to issue First Class Pass to the
eligible pensioners as per Rly.Bd. Orders dated 06-01-2011;
3)
Issue of First Class ‘A’ Pass to the ASCs/Ad hoc who retired before completion
of three years of continuous service as ASC;
4)
Regularization of ad hoc ASCs/retired in the RPF and promotion to the rank of
DSCs at par with their juniors to get pension benefits; In terms of item No.14
of the Agenda point of discussion of the AGM of the AIRPFOWA held at LKO,
reference 2 cited above, I am submitting my representation to you for further
necessary action.
5)
Payment of increment arrears due to the pensioners between Feb-June, 2006, on
account of implementation of VICPC pay scales from 01-01-2006;
6)
Many other local issues, like issue of Revised PPOs; resolving the difficulties
faced by members in the hands of the PDAs, timely issue of Passes- on the same
,and other offices in issue of timely pension, arrears, opening of joint SB account;
reimbursement/payment of amount spent on emergency Hospitalization at private
hospitals, restoration of commutation amount immediately on completion of 15
years, and so on.
In addition to the above, with the
encouragement and support extended by the President Sri. Y.N.Sastry, President
of AIRRF, and others, we are associating with them in day to day matters,
meeting the GM, IG-cum-CSC,COPs, Sr.DFMs, and others.
I am sending an amount of
Rs.300/- ( Rupees three hundred only) towards my annual subscription amount for
the year 2013 through my SBI/SB account to you – to SBI Park Town Branch,

I will be attending the next AGM

In
brief , it is submitted that I have joined the Railways as a direct
Sub-Inspector in 1970, got first promotion as Inspector in 1983, and in
May,2002 I have been promoted and appointed as ASC,RPF ad hoc, and on
31-8-2006, I have retired as ASC/ad hoc without regularization and promotion to
the rank of DSC on completion of three of service as was done to other directly
recruited ASC, and in later years , in 2007, DPCs were held and more than 100
ad hoc ASCs -- my other juniors got regularized and promoted to the rank of
DSCs, which was done in contravention to the DoP&T Orders and suppressing
other Orders of the GOI on the issue of time bound DPCs , no suppression in
promotions, to include the names of the retirees also in the DPC’s Panel lists,
etc. These entire Orders have not been taken in to account by the Railway
Board, DG, RPF due to which I was deprived of my legitimate regularization and
promotion as DSC at par with my juniors and other direct ASCs. Thus, I lost all
the pensionary benefits, and the juniors got more pay/grade pay and pension
than me. The facts and circumstances leading and relating to the matter are given
hereunder.
It is humbly submitted that I have been trying
to ventilate my grievance cited above, and the right to have justice from the
day I have completed three years of continuous service as ASCs for
regularization and promotion to the rank of DSC at par with that of direct ASCs
and other my junior departmental ASCs. My efforts to get this matter to bring
to the notice of the DG,RPF /Security Directorate on record failed and found to
be that my representations/letters/Minutes/emails; On line grievances sent
through MOR Portal, President’s Help Line Ports, Pension Portal, DoP&PW,
and so on, No where it is brought on record to indicate that this matter has
been brought to the notice of the DG, RPF, and thus in its absence, it is
opined , it stage managed somewhere, no action is found to have been initiated
as I have not received any letter/acknowledgment on this issue so far from the
Railway board, DG, RPF/Security Directorate. My letters, etc., have been piled
in other Ministries/Departments, cited above, who have without loss of time
sent them to the Ministry of Railways for appropriate action under intimation
to me. But nothing has been done so far.
Further, the Railway Board, have
published yet another seniority list dated
19-4-2012 of Inspectors/AD HOC ASCs for the years from 1983 to 2009 for
regularization of ad hoc ASCs and for promotion to the rank of DSC. The names
of the ad hoc ASCs, like me, have been dropped in the above list, may on the
ground that we have retired. The earlier lists of Inspectors-Grade-I dated
Apri,2001; 28-2-2005, and 04-8-2006 have not been finalized to fill up the
vacancies of ASCs on regular basis and further promotion as DSCs as arose
during the period from 2002 to 2007. I was in service during the period from
1983 to 2007. I have also lodged representation under Rule 102, but no reply
received so far. (Rule 102- Representation against assignment of seniority).
On my representations, they have also not
taken any action to initiate proceedings to rectify their mistakes done in
misinterpretation of the above GOI Order of the DoP&T date 22-11-1998 and
to issue DPC’s Extended Panels by incorporating our names/ retired ASCs as per
their seniority position of the year of vacancy and place them above their
juniors who were otherwise not fit /not eligible to be promoted to the rank of
ASCs/ and then to the rank of DSCs but for misinterpretation of this OM
and thereby mandating their names
inducted and injected in place our names. The said OM cited above very very
clear on this issue.
When the
matter has been brought the notice of the General Manager, East Coast Railway,
Bhubaneswar and our fate in the RPF as
ASC ad hoc pensioners, while our juniors are given higher pay/grade pay and
pensionary benefits by ignoring the GOI Orders cited above, the IG-CUM-
CSC,RPF, E.Co.Rly, BBS, vide letter NO. RPF /ECoR/E/08-03/491 dated 28-01-2013 had forwarded my representations to the Director, RPF, Railway Board for favour of disposal of the matter under intimation to me. It is not known , whether this letter also reached the DG,RPF or not.

Grievances, and Pensions, Office
Memorandum No. 22011/4/98-ESTT. (D), dated 12-10-1998 is enclosed
for ready reference and further necessary action at least now to set right this
matter and protect the senior’s pension benefits in the name of justice done to
one and all without fear and favor to person or class/cadre.
As
per the DoP&T, OM No. 22011/4/98-ESTT.
(D), dated 12-10-1998, DPCs have to be conducted in time, to promote the RPF
Inspectors as ASCs. In the event of failure to conduct the DPCs in time, due to
any administrative difficulty, delay, etc, the names of those Inspectors/ ad
hoc ASCs retired in the intervening
period should find place in the DPCs held in the later years, preparing
extended Panel(s), if necessary. Though such retired employees do not get
actual promotions and arrears, they are entitled to pro-forma fixation and
benefits thereof, such as passes, pensionary benefits etc.
Unfortunately,
in sheer violation of the above Orders, officers at the helm of affairs of our
department have delayed to conduct the DPCs in time, nor included the eligible
retired Inspectors/AD Hoc ASCs names in the DPCs conducted in later years, with
vested interest to benefit the persons of their choice, perpetrating great
injustice to the seniors, as a result, some Inspectors/ ad hoc ASCs likely to
be retired in the rank of ASCs/DSCs have retired as Inspectors/ad hoc ASCs
only. This injustice is still continued.
Despite the
fact that this matter has been highlighted in the Minutes of many meetings,
individual representations, and brought
to the notice of the officials of the Ministry of Railways; DoP&PW; Honorable
PMO’s Office; and the Honorable President’s Secretariat, no action to remove
this injustice is taken yet and therefore, it is still continued. The
RPFPWA,SCR, Secunderabad in its several Minutes requested the Honorable Minister of Railways to look into
this matter and render justice; duly sending the copies of the letters, etc.
along with copies of the Hon’ble Supreme Court/ Hon’ble High Court’s
Judgments/Orders citations.
Had the
Railway Board, implemented the Judgment/Order dated 07-02-2006 of the Honorable
High Court of Delhi in WP (C) 12612 to 12615 of 2004, in time, on or before
15-4-2006, my name would have been listed in the Panel List for the vacancy
period of 2002-2007 by the DPC, and I too could have retired as DSC, like my
juniors and got my legitimate Pensionary benefits in 2007 itself. Under the
circumstances enumerated supra, I humbly pray your Honor for kind intervention
on the matter and do justice to the senior citizens and RPF pensioners for
which act of kindness we shall ever be grateful.

clear to include the names of the retired employees also in the DPC Panel
List(s), even by making out extended Panels, the interpretation of the DoP&T OM No. 22011/4/98-Estt (D) dated 12-10-1998 by RPF Directorate, Railway Board is reflected in the following Para. This clearly
reflects the minds and determination of the vested interests sitting at the
Railway Board level who are stage managing entire affairs at the Railway Board
level even by misdirecting the other higher officials the UPSC, the Honorable
President of India’s Secretariat, and getting sanction and approval of their
choice Panel(s) names lists duly dropping the names of the retired RPF
Inspectors/ad hoc ASCs by making out delayed DPCs to eliminate the eligible
person’s names out of the list/s on this pretext of retirement…the DPC
recommendations were given effect to from 04-06-2004. Since Shri.
Gnanasambandham (DOB-12-03-1944) had ceased to be in service as on 04-06-2004,
the promotion order in his case was not issued, in terms of DOP&T’s
instruction contained in its OM No. 22011/4/98-Estt(D) dated 12-10-1998…”; What a typical type of
interpretation made to suit to their choice of inclusion and the same is being
followed for the last 3 decades in RPF. (B).
