COURT JUDGMENTS TO BE IMPLEMENTED TO ALL SIMILARLY PLACED PERSONS:
In some cases the Judgments are implemented to all the staff such as, application of 2.5 kms
distance for sanctioning fixed Medical Allowance, where as in some other cases it is made
applicable to the staff who have approached the Court. There should be uniform procedure and
any Judgment given by any Higher Court, it should be made applicable uniformly.
For example; the Railway Board vide Notification No.2004/SEC (E)/SR-2/4, dated 19-4-2012
published the revised Seniority List of Inspectors RPF (Under Rule 27(i)(e) of RPF Rules 1987)
for the years from 1983 onwards.
The names of Inspectors/ASCs Ad hoc who were in service as on 1983 to 2009 have been
dropped from the seniority list without assigning any reasons, while the names of the
Inspectors/ASCs Ad hoc retired during the years from 2009 to 2012 were retained, even though
this seniority list is prepared in April, 2012.
As per Department of Personnel and Training Cir.O.M.No.22011/4/98-ESTT.(D) dated 12-10-1998
and other letters, clearly indicate the procedure and directions for holding the Departmental
Promotion Committees (DPCs.) every year in time schedule and to include the names of the
retired employees also in the panel lists against the year wise vacancies even by preparing
extended panels.
In the RPF department the DPCs were not held every year, in time schedule on Administrative
delays. Due to which the RPF pensioners are losing benefit of notional promotion for which they
are eligible from the rank of ASCs to DSCs in RPF.
The Hon’ble High Court of Madras, while dismissing the Writ Appeal No.538/2012 in W.P.
No.16572 of 1998 filed by the Union of India, Railway Board, DG/RPF and others in its Judgment
order dated 12-6-2012 upheld the judgment delivered in WP No.16572/1998 …….. Directing the
Appellants to consider the Seniority list within the fixed time… Relief must be given to all the
Petitioners since at the time of filing of WP; they were very much in service…..)

In the light of this Judgment order, the RPF pensioners – Inspectors/ASCs Adhoc who were not
the Petitioners in the above W.P. have submitted their representations to the Railway Board,
DG/RPF with a request to consider such pensioners also on par with the case of the retired
pensioners/petitioners in the said WP and grant the same benefits of promotions and retirement
benefits to them.
