lists and by the DPCs -juniors given promotion as Commandants/DSCs in RPF
- pray justice and to Remove disparity to get Pensionary benefits-reg.

I humbly submit that I have joined in the RPF as Sub-Inspector in 1969, got promotion as
Inspector in 1983. In the year 2002, after due process by the Committee, Railway Board,
I have been promoted and appointed as Asst. Security Commissioner, RPF-Group 'A'
Cadre Post, retired on superannuation on 31-8-2006.
2) Due to administrative delays no DPCs were held from 2002 to 2009. I lost
promotional chance as DSC and lost pensionary benefits on account of no further
promotion to the rank of DSCs on completion of three years of service as ASC. On the
other hand, ignoring DoP&T Orders, several DPC(s) were held in later years and Panel
lists announced duly dropping my name and my juniors have been regularized and
promoted to the rank of DSCs in my place. I have submitted several representations on
this matter but no replies received so far.

3) Further, the Railway Board, have published yet another seniority list dated 19-4-
2012, of Inspectors/AD HOC ASCs for the years from 1983 to 2009 for regularization of
ad hoc ASCs and for promotion to the rank of DSC. The names of the ad hoc ASCs, like
me, have been dropped in the above list. The earlier lists dated 28-2-2005 and 04-8-
2006 have not been finalized to fill up the vacancies of ASCs/DSCs as arose during the
period from 2002 t02009. I was in service. I have also lodged representation under Rule
102 of the of but no reply received so far. (Rule 102, Representation against assignment
of seniority)
4) My name stands at serial number 101 in the 04-8-2006 List, while the names of
my juniors like, S/Sri. K.Laxma Nayak (Sr.No.113), K.V.Babu (143), K.J.Joy (170), and a
score 0 f others (40), have been promoted to the rank of DSCs duly dropping/sidelining
the senior's names like me. Great injustice has been mooted against us.
5) As per DoP&T.O.M.No.22011/4/98-ESTT. (D), Dated 12-10-1998 (copy enclosed
for ready reference), the DPCs held in later years have to include the names of the
retired employees also in the panel lists against the year wise vacancies even by
preparing extended panels. But, ironically, it was misinterpreted / or mismanaged
otherwise and our names have been dropped from the panel lists wantonly on the
ground that we retired on the date/year of DPC , when panel lists prepared and juniors
given promotions in our place by the DPCs, Railway Board and the DG, RPF . The same is
otherwise misinterpreted and stage managed all the time for the last four decades.
6). The Honorable Supreme Courts' Judgment Order dated 02-5-2011, in SLP-Appeal
(Civil) in W P No.14263 of 2004 in the Honorable High Court of Delhi and that of the
Hon'ble High Court of Madras, at Chennai, in Writ Appeal No.538/2012 in W.P.
No.16572 of 1998 Judgment Order dated 12-6-2012 in WP No.16572/1998, may kindly
be applied in my case also.
7) For the reasons best known to the administration, Railway Board, not followed
the provisions laid in Rule-27.2(b) of the RPF Rules, 198Z, and also not followed the
DoP&T Orders in regard to regularization and promotion of ad hoc in Group 'A' Cadre
Posts in the RPF, and ignored the Orders as cited in Para-5, above (Rule 27.2(b)
constitute DPCs preferably in the beginning of each year for selection to the rank of
ASCs /ACs and 27.1 (e) seniority list of Inspectors on all India basis).
8) Had the Railway Board, implemented1he Judgment/Order dated 07-02-2006 of
the Honorable High Court of Delhi in WP(C) 12612 to 12615 of 2004, in time, on or
before 15-4-2006, my name would have been listed in the Panel List for the vacancy
period of 2002-2006 by the DPC, and I too could have retired as DSC, like my juniors and

got my legitimate Pensionary benefits in 2006 itself. Contravening the above Orders, the
DPC was held in 2009 and Panel Lists containing names of 40 AD HOC ASCs declared and
promoted as DSCs. Herein again, the names of the ad hoc ASCs who were in service
during 2002-2008 have been dropped. This indicate that the Railway Board, have
purposefully violated Orders contained in the OMs No.220 11/4/98-Estt.(D) dated 12-
10-1998 of the DoP& T and also the Honorable High Court's
Orders.
9) While it is so for the departmental quota promotes fate as ad hoc ASCs, on the
contra, the Railway Board, under its front running powers, the direct ASCs, immediately
on completion of three years from the date of appointment as per UPSC date, are given
promotion as DSCs.
10) Under the circumstances enumerated supra, I humbly pray your Honor for kind
intervention on the matter and do justice to the senior citizens and RPF pensioners for
which act of kindness we shall ever be grateful.
