DoPT Vide a specific Office Memorandum No.22011.4.98.Estt.D. Dated 12.10.1998, given clear directions after consultation with the Ministry of Law, that in the event of failure to conduct the DPCs in time schedule, due to any administrative difficulties, on grounds of ‘reasons beyond control’, like Court cases, etc., the names of those retired employees, herein Ad Hoc ASCs. RPF retired in the intervening period, should find place in the DPC’s lists, if held in the later years, even by preparing extended Panels if necessary. Ministry of Railways, Railway Board, DG, RPF replied vide No. 2007.Sec.E.RTI.2, Dated 19-22 Sept-2008 that RETIRED AD HOC ASC NAMES.RETIRED EMPLOYEES have been dropped from the Panel lists as they were not in service, since RETIRED on the day-year when the DPCs were held, and quoted reference of DoPT- OM No. 22011.4.98-Estt. .D. Dated 12-10-1998. This is considered to be interpretation of their choice for applying only to suit to their convenience. KINDLY INTERVENE AND DO JUSTICE AND PROTECT FR 309 and OUR PENSION BENEFITS AT PAR WITH OUR JUNIORS by making out proper DPCs Panel lists by including my name above my junior to get pension benefit. 2) GOI/ Dept. of Personnel & Training issued clear directions Vide a specific Office Memorandum No.22011/4/98/Estt. (D) Dated 12-10-1998. This Order is still to be followed scrupulously as there are no changes/revision/amendments so far.
 In this OM, they have given clear directions after consultation with the Ministry of Law, that in the event of failure to conduct the DPCs in time schedule, due to any administrative difficulties, on grounds of ‘reasons beyond control’, like Court cases, etc., the names of those retired employees/ in our case, Ad Hoc ASCs retired in the intervening period of filling up of vacancies of each year and the actual holding of DPCs in later years, should find place in the DPC’s Panel List(s) if held in the later years, even by preparing extended Panels, if necessary.
The same is conveniently sidelined and misinterpreted by the Railway Board, RPF Directorate and retired employees names dropped and in their places juniors names included in the Panel Lists and given next higher promotions (in RPF).
I am pursuing since around eight years. When Petitions/Representations filed, they are just closing the cases by giving not relevant replies and not taking the above Orders of the GOI/ Dept. of Personnel & Training clear directions issued Vide a specific Office Memorandum No.22011/4/98/Estt. (D) Dated 12-10-1998.
For example, it is submitted that --------------------
The Railway Board, DG, RPF replied vide No. 2007.Sec (E).RTI.2, Dated 19/22 Sept-2008 that their names/RETIRED AD HOC ASCs NAMES ( RETIRED EMPLOYEES ) have been dropped from the Panel lists as they were not in service/RETIRED on the day/year when the DPCs were held, duly citing DoP&T- OM No. 22011/4/98-Estt. (D) Dated 12-10-1998. It is clear misinterpretation of the Order of the GOI.
 This attitude showed clear violation and suppression of the just rights and privileges guaranteed under FR -309, and clearly indicated that they have not worked out the Panel lists as laid in this DoP&T Memorandum, and wantonly misinterpreted the directions to suit to their choice.
We pray for regularization of ad hoc ASCs; to give pro-forma promotion to the retired ad hoc ASCs whose names have been dropped by the DPCs and give pro-forma promotion as DSCs-- AT PAR WITH THEIR JUNIORS AND SCRUPULOUSLY FOLLOW DIRECTIONS as per DoP&T ORDERS AND PLACE THE SENIORS/NOW SENIOR CITIZENS/SUPER SENIOR CITIZENS at par with their juniors to have pension protection / PENSION BENEFITS at par with their juniors. AND TO FOLLOW RPF Rules and the Law IN TRUE SPIRIT.
  KINDLY INTERVENE AND SEE THAT the Railway Board, DG, RPF to take some action to Honor FR 309 AND to render justice in this matter; KINDLY HELP TO RESOLVE THIS ISSUE.

NOTE: 1) I am struggling to get the word ” AD HOC ” WIPED OUT from our RPF since 2006; (2) I have posted several hundreds of Representations by Post/ On Line/through E-mails and so on since then giving all details including to Honorable President of India, PM, DoP&PW, Railways, etc. I have received replies from the Railway Board for some of my Petitions, one or two I am reproducing herein for your information, if need be, and interested to get the matter settled , please go through and take action as deem fit and proper. He was considered by UPSC for the year 2004 and 2005. Since he superannuation on 31.08.2006 his assessment is considered Not necessary in view of the DOPT OM No.35034/7/97 Estt D dated 08.02.2002. Due to different court cases the DPC was delayed and his promotion was not considered in due time. His juniors who were in service at the time of DPC got regular promotion. If he were in service at the time of DPC then his promotion might have been considered.
Honored Sir, the DoP&T OM No.35034/7/97 Estt D dated 08.02.2002, cited by the Railway Board has nothing to do with the GOI/ Dept. of Personnel & Training issued clear directions issue Vide a specific Office Memorandum No.22011/4/98/Estt. (D) Dated 12-10-1998, which they have to honor.

Grievance Description         :         – I, V.Seshadri, Inspector, RPF-Grade-I of 1991 Batch got promoted and appointed to the rank of Assistant Security Commissioner, (ASC) - RPF in June, 2002 duly approved by the Ministry of Railways. I have worked continuously, without any break against clear existing post up to 31-8-2006/till retirement. The Order made by the RPF Directorate, Railway Board however, cited the promotion as ‘AD HOC’. But for the reasons to be explained by them, they did not conducted the DPCs in the Scheduled intervals as envisaged by the Railway Board Orders/Notifications; and of the DoPT; not even followed the IREM Rules framed on the continuation of the AD HOC postings beyond one year; also made a deaf ear on the Orders/Directions of the Honorable Supreme Court, the Hon’ble High Courts delivered in different Writ Petitions filed by RPF officers etc. RPF Directorate, the Railway Board also not adhered to the Notifications and gone against the principles contained in the Standing Orders issued Vide D o P T- OM No:22011/4/98-Estt(D) dt. 12-10-1998, thereby they have wantonly ignored to include my name in the Panel lists- for the vacancies arises for the years from 2002-2006, later declared in 2009, by which time(2002-2006), I was working as ASC, not retired then. I am ASC appointee of 2002, and hail from 1991 Inspector-Grade-I Batch, but by dropping my name brought out my juniors names in the Regularization Panel, got approval of the President of India, and then promoted them to the rank of DSC duly throwing me down to earth on the ground that I have retired . This type of colluded methodology followed even from the year 1991 onwards up to 2010 against the departmental AD HOC ASCs/RPF, made them to retire, and /or conducted DPCs at their choice date and convenience year only to regularise the juniors and then promote them to the rank of DSCs to next higher scale. This can be got verified from the number of DPCs held for the years from 1990 to 2010, the Year wise Panel Lists made out, by getting the total names of year wise ASCs/RPF worked for 1990-2010; also to see if the names of the retired ad hoc ASCs were included or not. This Petition is filed for mercy consideration at least to have financial Pension benefits to me and to the retired RPF/ASCs and their family Pensioners/members. This ANOMALY ARISED ONLY DUE TO dropping their names from the PANEL lists by holding belated held DPCs in RPF; they indulged in Violation of Constitutional FR, Human Rights; Hon’ble Supreme Court, Different High Court’s Orders, Judgments, Directions issued to RPF Directorate, Railway Board, time and again, for holding time schedule DPCs, to regularize the AD HOC ASCs, but they did not obeyed the same. They side lined these Orders/Directions, and other Notifications of the DoPT, Ministry of Pensions, PGPW, UPSC, Railways issued under IREM, in regard to AD HOC promotions and appointment in Group ’A’ Cadre Posts in RPF etc. RPF Directorate and the Railway Board continued atrocities and irregularities, mischief acts against ASCs and in departmental promotions to the rank of DSCs. My Representation/Petition pending since years, even without acknowledgement - Pray intervention and do justice.

I have promoted and appointed to Group ’A’Post as ASC-adhoc- in May, 2002.My name stands in the consolidated list of promote-ASCs working on adhoc basis since 2002;Notification for regularization circulated in April,2006; DPC held and Panel names made out for the years 2005 to 2008,but announced in 2009.In 2005 and 2006 Panel Lists, my name dropped on the plea that I have retired from service in Aug, 2006.The High Court of Delhi in WP(C) Nos: 12612 to 12615/2004- vide ‘Final Order’ dated 07-02-2006 directed RPF to conduct/review DPC and finalize the lists not later than-on or before 15-4-2006 – the same not done-ignored, DPC held in Aug, 2009;Hon’ble President approved appointment of Inspectors/i.e. ADHOC-ASCs-Panel Lists made in May,2009.Promotion to the rank of DSCs were taken effect to all the ASCs (adhoc)who have completed three years of service my juniors; they have ignored the UPSC/DOPC/other-Railways-Estt.,RPF-Rules;not implemented/not honored the Supreme Court and that of different State’s High Courts ‘Judgments/Orders’ for conducting regular/yearly DPCs-various writ petitions on this matter-like--WPNo:4722/1985;W.P.No:15143/1990 of HC of AP; W.P.No:6631/2002 of HC of Madras; HC of A.P. Judgment/Order in WP.No.15143/1990 dated 26-3-1998,in W.P.No:4722/1985. UPSC had not conducted any selection for ASCs- direct for the years from 2001 to 2005 on account of Court cases. Direct recruit ASCs of 2000, were given training in 2002-3 and postings were ordered Aug,2003 regularized as ASCs, next promotion effected as DSCs immediately after completion of three years of their service. Justice may be rendered to me also. Delay of the Admn/RPF should not defeat the Equity and the Fundamental Rights of the Seniors’ status and Pay be protected and safeguarded by the Law of the Land, etc, and the Judgments/Orders of the Supreme Court and that the various High Courts in these matters be Honored. I pray YOUR Honour be pleased to consider the grievance on humanitarian basis to regularize my ADHOC ASCs service from 2002 at par with my Junior listed in the 2005/2006 Panel names, and to promote me as DSC, just to have my consequential Pensioners’ benefits.

Details :         Shri V.Seshadri Retd RPF officer was considered for regular promotion to the rank of ASC in Group 'A' Jr.scale along with his juniors through UPSC on 12.05.2009. He was considered by UPSC for the year 2004 and 2005. Since he superannuation on 31.08.2006 his assessment is considered Not necessary in view of the DOPT OM No.35034/7/97 EsttD dated 08.02.2002. Due to different court cases the DPC was delayed and his promotion was not considered in due time. His juniors who were in service at the time of DPC got regular promotion. If he were in service at the time of DPC then his promotion might have been considered

Honored Sir, Hoping that this will find place and time for someone to READ and take action and know what that had happened and happening in the Ministry of Railways, Railway Board , DG,RPF/Security Directorate, going on since decades duly sidelining DoP&T OMs..? Regularization of retired AD HOC ASCs and promotion at par with their juniors to get pensionery benefits: ... Inspectors, RPF when promoted as ASCs against their earmarked quota of clear and existing vacancies are kept on ad hoc basis for several years without holding DPCs in time schedule and thus rendering them unfit for the next promotion, on grounds of ‘reasons beyond control’, like Court cases, etc., thereby blocking their future and depriving them of their Fundamental Rights, like Article -309- to grow in life. And whereas, directly recruited ASCs are given time bound promotion as DSCs on completion of three years of service. IN our RPF Pensioner's Welfare Association, South Central Railway, Secunderabad, AGM held on 29-9-2014 unanimously resolved and requesting that the Railway Board, DG,RPF to scrupulously follow Dept. of Personnel & Training clear directions issued Vide a specific Office Memorandum No.22011/4/98/Estt. (D) Dated 12-10-1998, In this OM, they have given clear directions after consultation with the Ministry of Law, that in the event of failure to conduct the DPCs in time, due to any administrative difficulties, on grounds of ‘reasons beyond control’, like Court cases, etc., the names of those Ad Hoc ASCs retired in the intervening period should find place in the DPC’s held in the later years, even by preparing extended Panels if necessary. DG, RPF, Railway Board, is requested kindly look into this matter and do justice without further delay. We still having a prayer , in our mind, submitted and cited by our Honorable Supreme Court of India while delivering the Judgment Order in popularly known NAKARA CASE, regarding extension of pension, which we are now enjoying, which is but for his un-tiresome struggle. We still hope, now at least, our GOI take some action on our efforts, and on AD HOC ASCs system in the RPF, only for the departmental promotes , shall be dispensed forthwith and GOI/Ministry of Railways, Railway Board also shall honor the DoP&T OM cited above dated 12-10-1998 and uphold the FRs guaranteed by the Constitution of India and do justice to the retired RPF ad hoc ASCs by regularizing them and giving pension benefits, etc., at par with their junior, who would not have been promoted had the DPCs were held in time schedule by RPF and promote the juniors in place of seniors for the vacancies of previous years when these posts were in fact were held by the retired ASCs, but added word that they were on ad hoc basis and denied next promotion.......and so on. We pray for justice..... JUSTICE DELAYED, JUSTICE DENIED... JUSTICE DENIED... JUSTICE BURIED... BUT STILL WE ARE ALIVE TO STRUGGLE LIKE NAKARA.... HINDI WORDINGS--KINDLY READ.... But, the Railway Board, DG, RPF replied vide No. 2007.Sec (E).RTI.2, Dated 19/22 Sept-2008 that their names/RETIRED AD HOC ASCs NAMES ( RETIRED EMPLOYEES ) have been dropped from the Panel lists as they were not in service/RETIRED on the day/year when the DPCs were held, duly citing DoP&T- OM No. 22011/4/98-Estt. (D) Dated 12-10-1998. KINDLY INTERVENE AND DO JUSTICE AND PROTECT OUR PENSION BENEFITS AT PAR WITH OUR JUNIORS.
