ONE WAY TO CONTAIN/CURTAIL/ERADICATE- Corruption, the Basement of Black Money- CORRUPT PRACTICES, White Collar Crimes…:

The government is taking very nice and prompt steps by issuing Adhar Cards to one all; this may not authenticate the Indian citizenship, but invariably it should be useful for the individual and also to the government authorities like the CBI/DRI/ITax/IB/RAW/Customs and the lot. I would like to suggest some points for consideration to plug out at least some corrupt practices: like:-I am hold a respectful job with sizable money as out of the way income, but through honest means without any harassment and the like; this we call monthly MAMOOL,,as you all know; this exists in all the departments, private sector,etc...I go to some M. city and buy some gold ornaments on various names, then pledge in different banks, chit fund coys, etc. on different names - to a tune of say 5 lakhs every 3-6 months time; Have got any idea how to locate me; PAN card is on different names and addresses; but now the Adhar Card having my finger prints, photo, eyes, address, can be made useful to locate the mischief what i am doing in the name and style of honesty; let the Adhar card number be made compulsory in all fields of transactions, like the PAN in banks, or by IT as, assessments; the mention of Adhar Card No. shall be made compulsory in all the transactions including land dealings, registrations, purchases of any type of materials, articles, and the dealer/shop owner shall make a mention on all such receipts to authenticate their dealings by issue of receipts,etc... All the banks, chit fund companies, etc. where money/gold and other documents are dealt shall submit monthly statement to the income tax;commercial/custom/etc.and the cbi/ib/dri/raw/local police/cpos having Investigation authority shall make use of this adhar card number to find out the hidden things and the men; let the cell phone issue dealers also make a mention of this Adhar card number in the forms and for verification...

There is a saying--" Those who knows the mother, knows the world”. This caption might be true. Here, your mother is your inner mind and the conscience .But, in the case of white collar crimes or corrupt practices or accepting money from what ever may be the source of working by killing or sidelining the consciousness, and the cosine with corrugated mind lean toward compromise for personal gain by all means, that is all, you are doomed and swing into corrupt practices;

Corruption is but for someone, not to blame all. Corrupt practice is not one man's job. Only thing to stop corruption is his own mind and firm decision making capacity to be honest. That is in my view personal desire as mother and the next is the father-the greed; none to be blamed except the person who is or was over powered with these two matters. Corruption is and always associated with white collar crimes which go hand to hand with gratitude, certain realities and externalities, they follow loyalties in the business of corruption; some scapegoats shall be in readiness to accept and go to any extent of sacrifices. Greed is innate and insidious; it is like apatite stimulator but works under gyroscopic machinery /personalities... The honest shall wait and wait time to pause/pass, only to Honor YOU with glory. Whether every year 'the 9th December' or the UNCAC are they not functioning to eradicate corruption... Still things go on, as usual. All the personalities who value for corrupt practices and privileges with their power, authority, status, and the like does not yield to elders words to be honest. They does not like to value honest principles, they strive with money and the golden opportunities, may be for short time ,but still they flourish to that time and vanish as new waters come in.

The CBI is still a body having honest and sincere I.Os; take the famous UP-Lucknow's Madhumathi murder case of 2003,which still lingering in the History of the World News Makers like the Fox ;But this case also took several years-2003-07/and found to be still-it seems-Appeal Case is pending- The CBI shall try to handover the Case to a team of Investigators exclusively under the command and control of one DIG/CBI and there shall not any transfers, etc. unless there comes, on record, some type foul play, out of them; instead of transfers,etc, they shall be dealt directly under 311,that is all;(2) Like this case, why not the CBI take the Investigation of the National Volley Ball player who lost her leg in the recent attack on her by the Gold Chain Snatchers in a Express Train, and the case has already been come to controversial misgivings and media releases as the GRP-Government Railway Police-already named it as an accident on he other side of the track or/of attempt to commit suicide by her; why they shall not go in depth in to the case even by investigating the aspect of attempt to murder; why they do not ventilate and project the insecurity and personnel vacancy/ shortage of both the GRP and the RPF for providing escorts with A&A at least in all the Express trains over Indian Railways. · The friction and imbalance between the RPF and the GRP working stood as it was earlier even after amendments to certain Acts without touching the base element of the legal powers to RPF on the offences falling under the IPC or allied Acts. ( Former) Honourable President of India Dr. A. P.J. Abdul Kalam has presented the Presidential Colours to the Railway Protection Force on 22nd May, 2006 with certain observations and suggestions to the RPF / the Government of India, the Ministry of Railways, the Railway Board, New Delhi, to make rail journey safer and secure to the 12 million people including the tourists who are making use of the rail services every day.The Hon’ble President reiterated:

· (1) The need to remove the division of responsibility between the Government Railway Police (GRP) and Railway Protection Force (RPF);
(2) for empowering the RPF with legal powers to tackle all cognizable offences under the Indian Penal Code (IPC) and Special Acts so that there is a single point of responsibility for tackling crimes against railway passengers.Even three decades earlier and thereafter also there were lot of dialogue and paper work on the matter. But, nothing materialized.
Rail travelers-rail passengers and baggage is the victim on whose cost.

Always try to uplift the right matters and respect them with least nods or so at the right time for prosperity without fear and favour; like wise one shall not focus on personal gains and/or material gain interests in weight but for prospective matters that the Organization shall come up like the Honest of all and above the sky. Instead of pin pointing and trying to find fault with other’s views and vision on any matter if expressed, or trying to adopt ways and methods by trying or clouding the Intelligence reports concerning to the men and materials or by fully depending on the others working capabilities, try always to find out factual matters.

Corruption/White Collar Crimes/Black Money are all the decorative matters of the personnel/personalities with paraphernalia who strive hard by all means to get their choice of money to the extent possible to make out the black money in to white money and vice versa, the vicious circle continues to be adopted as long as they shall have the power, position, status, cadre and what not. The word greed and no greed has no meaning when once joined hands with the corrupt practices; they shall bow down to all types humiliations, insults, and what not? There may be some or the other type of explanations and excuses to over come the blame and their joining hands with such persons, but the aim and object shall be to get the money or money valued materials and or matters for them. The system goes on.

· What a wonderful matter--Dr Singh's promise of getting the dhan (money) back in 100 days, please explain what is the status? Query??? You a comment on this????

· The status shall be as is where is condition; we have ,in my considered view, no Law to force some one to disclose the Bank Accounts they held in India or in Foreign Banks, unless the CBI or any other I.O. with Authority from the Court take an Order to that specific point and query only. Then how one can expect that the Black Money (undisclosed) deposited by some one even on binary names, etc. shall be handed over to

Never, there is not even an Ordinance to ban circulation of RE:1000/- NOTE in market and that shall be deposited in the BANKS henceforth , say within one week's time,,, that is YOU see how much of Re:1000/- shall be there in the Banks account??? You can release the same after some months....

· A fact is always a fact that remains for ever whether you agree or not; I wish you shall not succumb to your monthly wants or require money to clear off your loans and for spendthrift , but still do not go for white collar crimes, or to work under some white collar criminal minded persons who may at this juncture pay you a lot and utilize your services and full fill their wants by using you in all means, but once you are spotted in some bad thing , that is all they shall make you the (e)scape goat and try by all means to finish you and wash their hands.

· MONSOON: A BOON OR BANE? Definitely it is a BOON, but not for all Hyderbadis! Where we are landing the Metropolitan city of Hyderabad! Exactly where we are, except for few exceptions like the Hitech city, widening of the roads on either side by removing the buildings, shops etc. The old city, and all other places where the low lying areas, newly stretched out roads, widening with out pre-thought about the blockage of rain water, unexpanded and 200years old system of drainage with out any improvement except in the Arena of Hitech city, we shall perceive and experience the havoc of monsoon season, like that of sea- son-see port areas in all the colonies, roads, blockades with submerged in waters…no body to be blamed on what? Thoughts- stress and strain--

Thoughts - -POSITIVE/NEGATIVE- IN (Y)OUR HANDS. There is a wall that separates each of us from our most important goals in life. The strange thing about this wall is that it is a barrier which we create for ourselves. like a brick wall slowly built in by adding one by one brick and concreted and double polished with out backward thoughts, creating doubts and fears in yourself is nothing but generating negative thoughts in yourself...With each problem you encounter, your doubts and fears increase. You start thinking things like:” I’m not smart enough to do this” I’m not capable of doing this” I don’t have what it takes to achieve this” I’m too old for this” I’m too young for this” etc. If you ever catch yourself saying things like this, it’s important to remember that-----" When you doubt your power, you give power to your doubts.” One of the most important principals for achieving success is to understand that your mind is like a garden bed where you cultivate and grow the seeds of thought. When you plant a positive seed of thought in your mind and nurture it carefully, it germinates and grows until it leads you to take action. As soon as you begin acting on your idea; your seed of positive thought becomes a seedling of positive action. If you continue to feed and encourage this seedling, it gradually develops into a tree of positive habit. Once this habit has become solid and immovable, it is then only a matter of time before it blossoms to produce the fruits of success. A negative seed of thought planted within your mind often leads you to take negative actions. These actions gradually develop into negative habits that will inevitably produce the fruits of failure. When you understand that your thoughts lead to actions and your actions develop into habits and that it is your habits that determine your results in life, then you’ll appreciate why it’s so important to be careful about the seeds of thought that you plant within your mind. One of the real secrets of success is to become a watchful caretaker over the garden of your mind and make sure that you only plant and cultivate thoughts that will develop into the positive habits necessary for making your dreams a reality. It means that you should carefully monitor the thoughts that you are plant become a watchful caretaker of your mind. Whenever you identify a seed of negative thought, uproot and discard it. Remember, it is much easier to uproot a seed of negative thought AT THE BUD ITSELF AND ROOT OUT THE SMALL BRANCHES TOO than it is to chop down a tree of negative habit that has taken root over many years. By planting and cultivating seeds of positive thought, you will set in motion a truly remarkable processing within your mind each day. Whenever you catch yourself planting or nurturing a negative thought, make the conscious decision to uproot and discard it. By planting and cultivating seeds of positive thought, you will set in motion a truly remarkable process. In the same way that a tiny acorn develops into a mighty oak tree, your positive seeds of thought will germinate into the actions and habits that will ultimately lead you to success. It’s equally important for you to depressurize after work in order to avoid bringing work related stress into your home.
A good way to think of this process is to imagine that you pass through a depressurization chamber on your way home from work. As you pass through your chamber, you eliminate the pressure of work so that you can return home in the right frame of mind to enjoy your evening.

High Powered Meeting to evolve new methods of ensuring better security of Rail Passengers was held in January 2010. The High Powered Meeting was attended by Member Staff, Railway Board and ex-Officio Secretary to Government of India, Director General, Railway Protection Force. (RPF), Home Secretaries of the States, the Police Officers In charge of Railway Security in States, Officials from Ministry of Home Affairs and Intelligence Bureau (IB) and other officials of Railway Board. This meeting is seen as a major initiative undertaken by Ministry of Railways on the issue of security of passengers and the keen participation of the State Government representatives was an important hallmark of the meeting. I have taken a chance to ventilate my views and vision through BPRD (Bureau of Police Research and Design) Review which is appended here under. BPRD is the right perspective/prospective to deal and make a way out? While the (RPF) is under exclusive control and command of the Central Government, viz- the Ministry of Railways and non-else, the other (GRP) is run by different State Governments in their respective territories, that too District wise and also Police Circle jurisdiction wise. Dual policy system, in matters of registration of crime cases, investigation, etc.! What does it makes a difference ( to the passengers) even if the RPF is made to work under the control and command of the Ministry of Home Affairs like that of the CISF? The President reiterated:

(1) the need to remove the division of responsibility between the Government Railway Police(GRP) and Railway Protection Force(RPF);(2) for empowering the RPF with legal powers to tackle all cognizable offences under the Indian Penal Code(IPC) and Special Acts so that there is a single point of responsibility for tackling crimes against railway passengers.

May I take this opportunity in expressing my further views on the matter appeared in the Times of India and for collecting and publishing the NEWS ITEM ON ::: MANY HEADS, NOT ENOUGH INTELLIGENCE ON 30-8-2007 issue, followed by some other points on the same matter in subsequent issues? I am of the opinion that the Article *the missing dimensions on security and safety of passengers-a point of view* written by me and published in the Indian Railways Monthly Magazine of June, 2007, issue, may also be connected to the subject matter. RPF is an Armed Force of the Union established and maintained by the Central Government / the Ministry of Railways for better protection and security of railway property, passengers, passenger area, and for the matters connected therewith. It is one of the

’s designated Armed Forces of the Union. Its jurisdiction spread through out the Indian Territory. It Works on the pattern of a Para-Military Force clubbed with some of the Police Powers, functions which include collection of Special Intelligence on one part; and investigation, prosecution of cases in the Courts of Law concerning to railway property on the other part . The Force engages itself independently in coordination, cooperation with the all the State Governments and the Centre. May I take the liberty in expressing my further views that every thing went on well while expressing and exposing on the Intelligence in TOI’ s issues, but, it is seen that they concluded the matter with out a word on intelligence system on railways. The security and safety of railway passengers, their belongings and railway property is but depended on good Intelligence governance. This is in my considered opinion seems to be lacking. The RPF and the GRP records on this issue over Indian Railways even for the last three decades can be looked into as regards to the attacks on the trains, stations, burning of Railway Property, looting of Railway cash, lose of human lives/personnel and the passengers, and of the Arms and the ammunition, etc ant be compared with intelligence reports on such matters.
Keeping in view of the above, present terrorism and Naxalite activities in the country in which, in my considered opinion the main target becoming the Railways, the Police Forces, and the Government properties, I tried to put forward an Article on this matter. It is felt that the Intelligence working system on the Railways was not looked into with real perspective and positive thinking, by any of the Top Brass or the Ministry of Railways, or the Ministry of Home Affairs itself. This may be due to lack of proper projection by the Security Advisors, or that the Police at the Centre and at the State level who does not appear to have applied its thoughts or an inclination to form a separate and independent Intelligence System to be enforced exclusively for the Railways network system . This may, I feel that in course of time, which eventually may cut short their control and supervision over the RPF and then the GRP. The other point is that the RPF is not under the Home Ministry, but under the administrative control of the Railways. I feel that it always weighs the matters for equilibrium with matching surrenders and/or with Revenue earnings/expenditure on particular issues. I am expressing my personal views with an earnest request to study the matter closely and with clear mind and arrange to get the matter solved. May I expect that my dream to become true and the expectation that Your experiences may lead the Railways Security Force, RPF or by any other name you may term it, takes its proper shape and reach to some RECOGNIZABLE place on one day or the other unexpectedly and there shall be good governance on the SECURITY AND SAFETY OF RAILWAYS WORKING SYSTEM, inter alia the safety and security of the rail passengers and their belongings, IN NEAR FUTURE?

Honorable Union Minister Mr. P.Chidamabaram as back as in 1988, while inaugurating the second annual vigilance officer’s conference at Chennai said—‘the virus of corruption appeared to envelop the whole fabric of society and when some people tended to be corrupt, even the honest people became suspect’.( The Indian Express- Daily News Paper- Hyderabad Edition, dated 22nd March,1988).The age old proverb continues to be up spring—“while honesty knock and waits at the door, the bribery enters in...”It is correlated and linked with the economic activity and advancement of science and technology, clubbed with the power and politics. It emerges on its own carves and crop up through mismanagement, ignorance, over confidence, dependency, over reliability, uncalled for rewards, praise, underlying assumptions, and so on. The characteristic trend of the white collar crime can be best equated with that of F. Engel’s words-‘it is self evident that where things and their inter relations are conceived, not as fixed, but as changing, their mental images, the ideas are like wise subject to change and transformation, as they are not encapsulated in rigid definitions, but are developed in their historical or logical process of formation…….’.It is talk of the day in general that when news surface on some white collar criminality, every one denounce it and make hue and cry for strict action against the defaulters and so on. From the next day on wards they forget about the issues, and put their sight on some other matter of importance.

The corruption and its practices have unabated trend as is emerging in all spheres of life under the guise of lacunae in the projection of evidence or through investigation loop holes. It is being protected and safeguarded by the vested interests during its official transactions for material or wrongful gains by way of inter dependence, and easy way of penetration into such agencies. These crimes are not generally located or identified by general public and even by others who have no access to the official dealings. Being a demi official and secret in transactions, it is spear heading by over coming the police net work and other Law Enforcement agencies by sociopaths. It takes its shape through learned behaviour, having a change and chance to leap when social status and position permits. It survives under active support of clientele it serves, with empiricism having authority and power. It is such a clandestine activity which do not easily attract the attention of the machinery or of the honest superiors unless and until its operation is leaked out through some source. It may not be out of place to mention the words appeared in ‘The Economic and Political Weekly- annual Number-1967’ .Its inner meaning to be applied openly with broad mindedness to fit to the present contest of white collar criminality. The paper quoted that’ …the question really is whether the present disorders and discontents are the prelude to a deepening political crises or only a passing phase. Any one who remembers the post independence history of India; one cannot honestly say that Indian politics are moving smoothly and tidily even when the Nehru era was at its peak….and any party that has been in power as long as the congress party has been in bound to become feeble, corrupt and demoralized…’.

The white collar crime generates through super derogative official actions concerning to an issue or project, and emanate at a particular time. At least one official is always involved in enumerating for its emergence through ante room. It is not that easy to read the minds of these officials, unless you join them, (at least as a decoy, and or act as a secret agent or dope), It is very difficult to find out the plan of initiation and action before it is worked out. It is a recognized arrangement and or an agreement between the vested interests; of course one should have high social standards, respect, domain, status and what not. Once the operation begin, they shall not have time to re generate to think of its side effects as the material or wrongful gain pour in and they are caught in a vicious circle. Is there any remedy or resolution to solve the problem of white collar criminality? Certainly, one can say yes. There should be a favourable and positive answer. Of course, the crime and disorders in the society attract the Law and the Law enforcement agencies. But what about the white collar crime, which is independent of itself. The authority in power has to analyze as to how and why it is living and surviving from within itself, and why it is even withstanding the pressures of the society; why the Law enforcement agencies are unable to tackle it effectively and efficiently; why it is grooming forward with out any sudden death or ineffectiveness. For all these questions and problems, sincere and honest answers are its solution. Bring the honest top officials to the fore front. Change the pattern of selection of the top brass and other designated jobs. It is my opinion to select sincere, good, and efficient personalities from all fields including the public and private industries; make coordinated committees; the chartered accountants, the doctors, the engineers, the bank officials are the officials who can also lay hand and curb this menace at the beginning. There shall be a separate department by itself. The Intelligence departments and other co related Vigilance branches of the Central Government and of the States, the Economic Offences Wing, the Customs and Central Excise Intelligence wings the Narcotic and Drugs control wings are some of the citations which are dealing with the specific nature of offences. These are supplemental to bring down the economic offences. But, it is opined that they can not eradicate the so called white collar crimes which take its bud from within and emerges surreptitiously unless curbed at the beginning itself. It is opined that by a special Act or other wise, there shall be a separate department at the Centre under the exclusive control and supervision of its Chairman and the Chief Director General and he shall be answerable to the Parliament and to submit annual report. Like in the IPS officers’ cadre transfers, seniority and promotions, the personnel from one Force shall be subjected to transfer to the other Force, so that there can be no ambiguity in their seniority and promotions, being centralized services in

. As seen from the present set up there are many a number of Armed Forces some working under the exclusively control and command of different Ministries of the Central Government, having there own set up of selection process and procedure, transfers, seniority, and promotional channel. Let there be one SYSTEM AND ONE TYPE OF RULES AND REGULATIONS FOR THE ENTIRE CENTRAL POLICE /ARMED FORCE PERSONNEL COMING UNDER THE PURVIEW, CONTROL AND COMMAND OF THE MINISTRY OF HOME AFFAIRS/MINISTRY OF RAILWAYS (THE RAILWAY PROTECTION FORCE). WHY SO MANY SELECTIONS/DIFFERENT SETS OF DESIGNATIONS/CADRES/SET OF RULES FOR PROMOTIONS/ADHOC PROMOTIONS(RPF)CONTINUATION FOR SEVERAL YEARS EVEN DECADES WITHOUT CONFIRMATION, WHILE DIRECT OFFICER GETS PROMOTION JUST AFTER COMPLETION OF THREE YEARS LIKE THE RAILWAY 'S OTHER CADRE OFFICERS....

Unlike that of The Railway Protection Force, it is believed that in India there is no other Force having only two types of group cadre posts-Group ’C’ and Group ’A’. There is no system of other channel of promotion, a Group ’C’ cadre post personnel shall be promoted directly to the Group ‘A’ cadre post. Like all other Central Government and the State Government departments, there should have been four Groups in the RPF department also and shall be brought under the control and command of the Ministry of Home Affairs. All the central police forces and other armed forces shall be brought under the command and control of the Chairman and Chief Director General of the Central Police Organization under the Ministry of Home Affairs. There shall be only one type of selection process, procedure. The Rules and Regulations, and the departmental proceedings shall be same for all the Force personnel whether working in the States or under the Central Government services or at nominated public undertakings. There shall be a separate Central Intelligence Wing exclusively to deal with white collar crimes under the Ministry of Home Affairs. Like the Central Bureau of Investigation, or the Intelligence Bureau, it shall pas on the forecast and the intelligence to the Director General for its evaluation and further process to eliminate black sheep’s from the concerned departments. The incumbents shall be drawn by an honest selection process. Qualitative selection shall be need of the hour to curb the white collar crimes. The Central and the State Service Selection Boards or the Committees shall be under one command with one and similar type of centralized selection process, in so far as the selection of police or other subsidiary forces/ DESIGNATED OR NOMINATED AS ARMED FORCES OF INDIA LIKE THE RPF (but in fact work under Ministry of Railways(industry) and not even the Ministry of Home Affairs) selections takes place; there shall no differentiation between the ranks, cadres or groups from one Force to the other one; whether it may be working for the State or for the Central Governments.

The administrative set up of the local rulers has been taken over by them by administering justice to the people in the civil and in the criminal nature of wrongs. The British, having experienced the impact of the Indian’s strength in the 1857 ‘First War of Independence,-‘The Sepoy Mutiny’, thought of more economical and organized substitution in place of their Military power. With the result, the Police Commission of 1860 recommended for creation the civil constabulary as a substitute to their Military Force. By taking the Indians into confidence and successfully utilized them as a watch dog through a duly enacted Law that is ‘The Indian Police Act, 1861’.Their aim was to establish them in

to preserve internal tranquility and peace using the so called police as a more effective instrument under their command. However, after independence, the police is engulfed with multi furious duties and its working acquired special importance in our welfare state and the current thinking is to transplant the organization as an “ instrument of service” and not as “Efficient Instrument” only. The Indian Police Force now aimed to safeguard the interests of the society in addition to maintenance of law and order and general welfare of the society at large. But it is unfortunate that even after 50 years of democratic living, the unhappy reflections of the British ‘Master and Servant’ charged with pessimism, forgetting the reality that governments have come and gone but the police still manage to preserve the macabre heritage and thereby; ignore the message of the Mahatma that”-service without humility is selfishness, and even today there is an iron curtain drawn between the Police and the people in this country. The impression of the people that they are denuded of their fundamental right of approaching the police shall be erased by exhibiting love and affection by the Police in their routine duties. Duty devoid of self imposed discipline and devotion, brings disrespect and develops hatred toward any organization. There must be mutual accommodation and understating between Statutory Police Forces and a democratically established State like

The PREAMBLE of The Police Act, 1861 envisage”-where as it is expedient to reorganize the police and to make it a more efficient instrument for prevention and detection of crime……”It is still fresh in our minds and making us to believe that the police organism is an ‘instrument’. This conception is not only faulty but is not in line with the changing socialistic pattern of the society and the legislation. The preamble of any enactment is considered to be the watch dog of the philosophy of the legislation. The line of thinking that the preamble is the watch dog and the guiding rod for any enactment is not only a historical past but it is still the present reality. An “INSTRUMENT’ is nothing but a tool, a tool in the hands of a skilled worker will give better results. The instrument alone cannot be found fault with, and move so as per its usage if handled by a misfit. The Police as an instrument designed and created for better services. One should shake off the dust of the past and plant his feet firmly in the present system. While the words may belong to the old order, the sense should radiate to the new order of thinking. Let us give them respect, respect that money cannot buy, but which they deserve; when they are trying to protect the society from those who seek to endanger or destroy it...”

It is apt to quote the words of the former Prime Minister of India, Late Mr. Pandit Jawaharlal Nehru,”... In India, there is a hangover of old days when the police was distrusted and considered as something apart from service in peace time…”Certain groups and forces have combined the police and the law, not allowing law and order to be enforced and there by respect for law and order deteriorating. These comments of the greatest leaders of the democratic countries advance the thought that the police is not only meant for prevention and detection of crime, but it has a noble role to play in a welfare State by infusing confidence in the fevered life of the modern society that the police is his ‘friend’. The thinking that-‘the police are for the politicians, of the politician, buy the politician….’ And that …’ the police are far (away) the people, off the people, and buy the people....’has changed its circumference and barricades towards the welfare of the people.

Chidambaram, Union Minster while inaugurating the second annual vigilance conference, at Chennai are worth found to be quoted..’ the virus of corruption appeared to envelop the whole fabric of society and when some people tended to be corrupt, even the honest people became suspect…” (Indian Express- Daily News Paper- Hyderabad Edition, dated 22-3-1988).It is thus surmised that the Police identification and working varies with the changing political rulers and that the values by segregating themselves from the society is also never the less polluting the police –public relationship...The cordial principle of three ’Ds’—Duty, Devotion and Discipline’ among the police personnel is very often lost sight of.

This may be due to various reasons like discontentment, white collar criminality, disparity in pay, nepotism, red tape (ism) and political interference. Indiscipline in the Police Forces is ever increasing because of the preferential treatment and undue favoritisms shown by a few officers to their subordinates like postings of their choice, rewards, medals to their near and dear, denouncing the same to the right person on one pretext or other. Mr. D.N. Gautam quoted”...a situation legal disorder was sought and created in the police supreme and actual conducting of police affairs…”... Hindi movie”Ardha Satya” depicts a system of police working, corrupt practices, and as to how the rightful persons are side lined, etc. In the words of Mr. S.K. Ghosh,’... policing of the area is rarely thought of during the planning stage, and when law and Order problems arise, some police posts are created hurriedly and policemen are posted overnight without providing them with adequate accommodation and facilities which are made available to workers…’…’ a policeman hardly knows a Sunday or a holiday and the periods of festivals and festivities; frequent law and order problems are generally the periods of stresses and strains for him; the matters that affect a policeman’s daily life are housing, medical treatment, education an family welfare. It is of vital importance to a disciplined force that its welfare affects to a great extent its moral and efficiency’...The Police Forces and the police –public relationship, its services towards welfare of the society can be improved and streamlined to a larger extent if its working is reflected and directed by making the personal contacts with the public more effective and result oriented, the top brass take firm and decisive actions against the black-sheep. The Government can take into consideration about the inadequacy of the Police force personnel to deal with the law and order problems arising out of in consequence to various aspects, which may ultimately lead to hooliganisms, arson, looting, and opening of firing at the unruly mob, etc. The Police Forces are found to be becoming the targets for all criticisms and these are some of the factors which eventually impinge on the working the Police Forces. The Police working system can also be encircled as the instrument of service to the society. The Police can exhibit its essence of service as its motto, that service is love and that the heart has no language and it speaks to the heart and the sole. Its aim is meant service and non else. The ‘ANTHYODYA AND YESHOLABHASWA’ shall be the objective of the Police Forces.

THE MISSING DIMENSIONS ON SECURITY AND SAFETY OF PASSENGERS-A POINT OF VIEW-(“INDIAN RAILWAYS”- MONTHLY MAGAZINE-JUNE-2007- )Honorable President of India Dr.A.P.J. Abdul Kalam has presented the Presidential Colours to the Railway protection Force on 22nd May, 2006 with certain observations and suggestions to the RPF to make rail journey safer and secure to the 12 million people including the tourists who are making use of the rail services every day.

The President reiterated : (1) the need to remove the division of responsibility between the Government Railway Police GRP) and Railway Protection Force(RPF);

(2) for empowering the RPF with legal powers to tackle all cognizable offences under the Indian Penal Code(IPC) and Special Acts so that there is a single point of responsibility for tackling crimes against railway passengers. Even three decades earlier and thereafter also there were lot of dialogue and paper work on the matter. Referring to the policing and police service in the Indian Railways and the role of the RPF, its constraints and improvement, in the 1976, Shri. P.S. Ram Mohan Rio, IPS, DGP (Retd) and former Governor of the Tamil Nadu, when he worked as DIG-cum-Chief Security Commissioner, RPF, South Central Railway had observed that “the tendency to change the RPF with policing duties on the railways is on the increase, policing on the railways in regard to both maintenance or order and prevention, detection of crime relating to the person and to the passenger should be the exclusive concern of the GRP controlled by the state Governments.
Any scheme will not only result in multiplicity of agencies, frequent overlapping of responsibilities and efforts, but what is more important will generate needless frictions between the State Police Forces on the one side and the other agencies(RPF) entrusted with similar duties on the other. There is an urgent need to have another look at the pattern of organization the RPF and bring about suitable modification to enable it (RPF) to meet at least its basic tasks”. In May, 1985 I have submitted an Article on the subject matter for publication in the RPF Journal etc., for which my Superior Officers might have thought as not worthy to be known by others and I think, filed the same. Without going in detail about the organizational set up of the RPF, it is suffice here to mention that in terms of ‘ The Railway Protection Force Act, 1957’, it is constituted and maintained by the Central Government ( the Ministry of Railways and not by the Home Ministry) for better protection and security of the railway property. The act has been further amended in 1985 thereby the RPF has been equated as ‘Armed Force of the Union ‘.In additions to the railway property, enhanced functions, powers and responsibilities about the safety and security of the passengers, their belongings, and passenger area were vested on the shoulders of the RPF by another amendment to the Act in the 2003 without empowering the RPF directly and independently to deal the offences pertaining to and connected therewith which eventually comes under the purview of the IPC. In short, all such cases detected or apprehended by the RPF have to be handed over to the GRP for further legal action like registration of the case, investigation and prosecution.

I would like to mention as to how the GRP and RPF are working on the railway system by quoting a sentence, “Nothing can be farther from the truth. In essence while the soil is ruined on the one hand by excessive chemicals the input ratio on the farm increases every season. The farmer is caught in a vicious cycle”—‘Slow Death: SURYA, March, 1989’.Here, I equate soil as the RPF, excessive chemicals as the amendments to the Acts without Police powers to RPF and retaining the GRP as it was, the farm is the Railways, and farmer is the passenger. The RPF is empowered by Law to deal with offences falling under the definition of ‘railway property’ under the Railway Property (Unlawful Possession) Act, 1966. There was amendment to the long title of the RPF Act, 1957 in the year 2003, wherein with out changing the meaning of ‘railway property’, the title has been enlarged and substituted to include passenger area and passengers; but the definition of railway property stands as it was in the year 1957, i.e.” railway property includes any goods, money or valuable security, or animal, belonging to, or in the charge or possession of, a railway administration.”. So, to say, that the passengers and their belongings even though they come or remain within the railway /passenger area does not belong to or in the charge or in possession of a railway administration. This fact itself shall bar the RPF from taking any action under Law to deal any offences pertaining to the above and hence invariably under all probabilities, all such cases have to be handed over to the GRP for further legal action. Thus, the friction and imbalance between the RPF and the GRP working stood as it was earlier even after amendments to certain Acts without touching the base element of the legal powers to RPF on the offences falling under the IPC or allied Acts. It is more and more very clear without any ambiguity that as per the statement of objects and reasons of the RPF Act, the legislation has designed to bring about a radical change in the functioning of the department, by reorganizing it, to provide in times of need, suitable assistance to the Railway Police who are charged mainly with the responsibility for overall maintenance of law and order in railway premises. Ironically it can be seen that ’ The Police( Incitement to Disaffection) Act, 1922 ‘ has been made applicable to the RPF by virtue of its inclusion in the RPF Act making it to the subject of the Police Force only to the extent of said Act and not otherwise. Again some other Acts like ‘ The Payment of wages Act, 1936 ‘, ‘ The Industrial Disputes Act, 1947 ‘, ‘ The Factories Act,1948 ‘ or any other Law corresponding thereto shall not be applicable to the RPF. It is very precisely added by the Statutes to exclude the RPF as they are working on the Railways system which is an industry and for some extent the RPF personnel were regarded as Railway servants only to deal some offences under the Railways Act. Even though here were amendments to the Rules (in the years 1988, 1999, 2001), pertaining to the Railway Notices of/and inquiries into accidents Rules, Statutory Investigation into Railway Accidents Rules, the name of the RPF has not been incorporated at any corner of the said Rules for its participation or association in any manner in any such inquiries or as one of the member in the joint enquiries. Here again the GRP alone has been included and entrusted by Law to deal such matters and not the RPF. However, in all such matters RPF officers associate in all respects, submit their reports, etc.

In spite of all such official exclusion by was of Rules and the Law, as per local orders, if there were any lapses on the part of the RPF personnel to the extent of and up to the rank of Inspectors, they shall be taken up departmentally in regard to their duties etc., connected to the railway accidents and untoward incidents, on its reports/enquiries into such incidents. By ‘The Police Act,1949 ‘, the Central Government has constituted a police force for general police-district embracing two or more Union Territories and for the establishment of a Police Force therefore. The same procedure can be adopted to enforce a single Police Force on the Indian Railways. It is pertinent to spell out that there can be some consensus between the State Governments and the Central Government either to merge the RPF and the GRP as one Uniformed Force only to deal the offences on the Railway system or to find out ways and means to include the RPF, now may be one of Central Para Military Forces (CPMF), and now to be brought at par and as one of the Police Force like that of the other Central Police Organizations ( BSF, CISF, CRPF, ITBP, Coast Guard, etc ) even by amending ‘ The Police Act,1888’ or ‘ The Police Act,1861’.The Central Government can also make a separate Act like ‘ The Police Act, 1949 ‘, thereby including the RPF befitting as a Police Force to deal cases exclusively on Railways. The Central Government can also constitute a separate or special railway districts embracing parts of two or more States and Union Territories, and extend it to every such part of the said district the powers and jurisdiction of a Police Force as belonging to a State to be specified in the Notification. By this, the RPF can also be vested with the powers and functions of the Police Force on Railway’s System.

PRESENTS PRESIDENTIAL COLOURS TO RAILWAY PROTECTION FORCE) (“INDIAN RAILWAYS”- MONTHLY MAGAZINE-JULY-2006)In a colorful, solemn and inspiring parade ceremony on 22nd May, 2006 Railway Protection Force (RPF) was presented with the Presidential Colours by the Hon’ble President of India, Dr.A.P.J. Abdul Kalam. The function was attended by Shri Lalu Prasad, Minister of Railways, shri R.Velu and Shri Naranbhai Rathwa, Ministers of State for Railways, Shri J.P. Batra, Chairman, Railway Board, Shri. A.K. Suri, DG/RPF and host of other dignitaries. The glittering function was organized in the RPSF premises in Dayabasti, Delhi. The Hon’ble President during his address greeted the Commanding Officers and all ranks of the RPF on the auspicious occasion.The Hon’ble President in his speech emphasized on the need for use of information and communication technology in removing the jurisdictional anomalies arising between place of occurrence and place of reporting of crime by passengers. In his opinion the technologies, should provide a new dimension for policing, surveillance and dealing with criminal and maintaining law and order in the trains. He also reiterated the need to remove the division of responsibility between GRP-Government Railway Police and the RPF-Railway Protection Force and empowering the RPF with legal powers to tackle all cognizable offences under the Indian Penal Code and all special acts so that there is a single point of responsibility for tackling crimes against railway passengers.Dr. Kalam made the following suggestions to RPF to make rail journey safe and secure to the twelve million people including tourists who are making use of the rail services every day.
PERFORMANCE ANALYSIS:
An analysis should be conducted about the frequency and the type of crime occurring against Railway passengers in different parts of the country. Based on this analysis special strategy should be devised for combating crimes in areas where its frequency and intensity is very high for ensuring safe travel for passengers in the region. Also, all the RPF units should be networked in the country so that rapid mobilization of additional resources can be done in difficult areas. The Indian Railway name for the service will further be enhanced by incorporating the following addition missions for Railways-RPF:·                 A child below the age of ten or a senior citizen should be able to travel from Kanyakumari to Dispur (Assam) safely like a child or senior citizen is able to travel from Atlanta to Madurai by air without an escort.·                 A young lady should be able to travel safely without a companion from Mumbai to Patna and reach home safely.·                 All the passengers traveling in the trains should feel confident that their belongings are safe and that they do not have to spend sleepless nights worrying about the loss of their luggage.·                 The international; tourists should be able to feel that train travel in India is passenger friendly, safe and secure.
Railway Protection Force should aim for realization of such a level of safety by the year 2010.

WHITE COLLAR JOBS---WHITE COLLAR CRIMES- CORRUPTION AND BLACK MONEY PAVES IN-HOW TO TACKLE?

Mathai, Mr. Jawaharlal Nehru’s Special Assistant, in his Book “ Reminiscences of the Nehru Age” quoted “ all politicians are like squirrels… and that no mater how old the squirrel is, it will never give up climbing.” I am of the opinion that these words are found to be equally suited to the white collar crimes and to its perceptual. He, who knows his mother, knows his god; he who is free from debt is the richest man in the world. IN MY CONSIDERED VIEWS, THIS QUOTATION IS ONLY APPLIES TO PERSONNEL WHO ARE HONEST AND SINCERE TO THE CORE AND NOT TO OTHERS AS THEY HAVE DO NOT MAINTAIN AND LIVE ON ""manam and abhimanam"... “white collar crime”-In the present days of living, the word-white collar crime—brought out to lime light, by Mr. E. H. Sutherland, as back as in 1940s, is found to be changing its trend ,fashion and bounds. It was termed to mean          ” approximately a crime committed by a person of respectability and high social status in the course of his legitimate occupation”. In its 47th Report, the Law Commission termed it as” a crime which is committed in the course of once occupation by a member of the upper class of society”. Honorable Union Minister, Mr. P.Chidamabaram as back as in 1988,while inaugurating the second annual vigilance officer’s conference at Chennai said—‘the virus of corruption appeared to envelop the whole fabric of society and when some people tended to be corrupt, even the honest people became suspect’.( The Indian Express- Daily News Paper- Hyderabad Edition, dated 22nd March,1988).The age old proverb continues to be up spring—“while honesty knock and waits at the door, the bribery enters in...”It was said that any ruffian can defy the boss, the prince with impunity, and an imbecile in power sacks worthy men also if they dislikes or get them out of their division/or the zone. They also whisper that the power politics with in the department prevail. They grumble to the extent that ‘A cur that prefers to bite a shoe does not know the taste of sugar cane’.

How to deal such personalities? This is the question honestly posed by some intellectuals. Referring to some of their known officials, they said the administration, found to be finding it difficult to post such officials continuously at one place and that the other officers have even gone to the extent of rejecting the postings of such officials under them, When such was the situation, how to tackle them and curb such mal practices being adopted by such persons. Some of them suggested that the unwarranted personalities of such nature having white collar criminality should be fished out exposed with full history of their activities and to be dealt harshly. All such persons faces to be shown openly, with out covering their faces with black bags, make them to be known and alert the authorities with wide publicity to make beware of them, to identify them, to crush them with iron hand, confiscate their properties, ill gotten money, seize the bank deposits and the like. They continued to state that the Law to be amended to frame them and to suit to such personalities, and by hook or crook to eliminate them once for all from the department without any mercy. It felt by them that, they are like cobwebs and cancerous to the society and to the department, in fact to the society it self. There shall be a separate department to deal such people, officers. The ill gotten wealth and luxurious properties, lands, and the like are to be brought to books to be used for other welfare purposes. Some of the officials who are not out spoken and stick only to the assigned work found to be having a feeling that the lower cadre are dealt with severely while the higher ups are pushed aside, side lined and dealt very leniently by safe guarding the cadre officials, in the name and style of departmental rules, lacunae in the enquiry and/or no proper evidence and the like. The image of the department depends on their activities, as they are holding high level positions and ranks. The image is in their hands. The honest handles the matter and look at them in haste and evaluate them as they stand very low rated personalities, and at times equalizes them to that of the criminal minded, or the criminal in uniform. This engulfed matter seems to be is nothing but due to timely inaction, late reaction by the top officials who happens to work under no pressure and not serious on time bound factors to be complied with by other higher authorities. The belief of the reformers, if any is still sinking. For this type of working system who is to be blamed? The department or the personnel involved or the top officials who just over look on suit was said that any ruffian can defy the boss, the prince with impunity, and an imbecile in power sacks worthy men also if they dislikes or get them out of their division/or the zone. They also whisper that the power politics with in the department prevail. They grumble to the extent that ‘A cur that prefers to bite a shoe does not know the taste of sugar cane’. The grime with fantasia fangs; the whole image is alarmingly becoming infected, and shall be damaged like germicide penetrating through its personnel, if no check mate is put in time. It is having very long backing and recognized that the white collar crime as the most dangerous thing to the society and to the economic pattern and spreads like cancer. But, still for all, it is found to be occupying its high position through several steps and ranks, penetrate in to the minds of the corrupt and settles down and continues to dominate all others by way of influence, power, authority, status and money. It was a question as to how to eliminate it and destroy it permanently from the minds of such corrupt persons and make them to respect the country, the Law and make them to become honest to the core. It is observed that the white collar criminal activity engulfed in the minds of the personnel in such a way that it has gone to the extent for infraction in all levels and at many stages and to be managed at any cost. Even if some good advice comes from higher authority, the well wishers, it rarely deters the cupidity and that their mind not changed. They always find themselves in good humor; find loop holes and search for escape clauses to come out from the misdeeds. The career continues until they are put behind the bars or firmly dealt with under some type of departmental action with a determined object to weed them out from the department. But again, It is observed is some such cases too, they spend huge amounts they earned to get the case viewed leniently and to set aside the punishments and the like. This is the vicious circle system and the backstreet analogical things are found to be going on.

When something goes wrong we immediately begin to look for excuses, or explanations, why that mistake happened. This finishes our power of realization and we will not be able to recognize our own mistake. Then we will not be able to work at improving ourselves and we will not be able to bring any transformation.
Instead of looking for excuses for what all happened, we need to take the opportunity to check within ourselves and see our own mistake(s). When we recognize our mistake, however small it may be, we will be able to work on it. Only when we are able to realize our own mistake, will we be able to bring about transformation in ourselves.

It occurs only when we does not compromise with the words spoken against or toward us, this is insult only when our discrimination has in fact failed us to understand in retrospective or prospective or when our mind thoughts stopped Yoga and meditation aspects:·        When we feel insulted and then utilize the Sadhana and retire into seclusion for a while and reflect our Guru-the soul and retrieve the matters in all the ways-- that;·        He/ or they insulted only my body, mind and little self, I did not loose any self respect at all, who are they to talk about me, I am not that;·        He can not insult my real self, the soul, because he himself is my own self; I shall make best use of it to analyze it;·        By insulting my little self, he is really helping me in dissociating with it;·        His insult has enabled me to come face to face with my own egoism, my interaction with my soul, God has given me an opportunity to crush it once for all;·        The only new point of version, now I discovered is—he has pointed out openly to me what he considers/considered as a defect in me; he has given me an opportunity to analyze the same for myself;·        O’ God, I am always thankful to him:·        Now, I do not get irritated and I shall not get angry and console my self and my soul:

                                             In the present computerized generation system, it is a well established phenomenon that at any palace, or place, or for any matter, as we submit the query, comment or the criticism, a well designed computer, within seconds automatically evaluate the answer and the grading too and that is all, you get the reply without further query and the matter is treated as closed once for all. Seldom there may be a response form the Editors or from the administrative machinery for which one should always feel free to express and convey the thoughts and what not? ·                                                   What actually one to mean and think about the consumer protection and how this connected with the rail-passengers over the Indian Railway’s System?·                                                   Is it not the duty cast on the government, or in fact the Indian Railways to safeguard the interests of their passengers;·                                                   Will it not come under the purview of Consumer Protection;·                                                   Will every person feel and adjust that some graded and defined matters of the goods and the products or of that sort shall only be the matters within the encircled phenomenon of consumer protection;·                                                   Why all confine their minds and the thoughts, process, only toward some settled matters or wait for the Apex Court to express its views and then to follow the lines; Now, think of the Generation Gap and try to enlarge the master minds process of refining and redefining the safety and security of the rail passengers which may encompass the matters under consumer protection. Expand the matters of sabotage or/ and other type’s of acts and the results of its impact on the human beings, the government, and on the public and private properties;·                                                   Who are all responsible for its non-visualization in advance through Intelligence System;·                                                   Why there shall be such activities on the Indian Railways at all? Who is going to pin point the fault and express proper remedies to tackle and solve the problem at its bud itself?·                                                   Why there are such delays and ‘after attack investigations’?               Within no time of the incident, like train accidents or of that sort, ·                                                               send some type of sympathetic words; ·                                                               take on the spot decision for making orders- (without further process of its implementation, even if it materialized, when and after how many years?);·                                                               VIPs/VVIPS visits; ·                                                               announcement for payment of ex gratia to the victimized family members; ·                                                               or/ in addition offer some type of compensatory appointments; and ·                                                               Finally condemn with one voice by deploring the activists as a tame work or cowardice activity, etc, etc,                    That is all, every body is busy with other routine works of their own.·                                                   To keep the sequence and to find out the reasons, there shall be another mode, to appoint a Fact Finding Inquiry or entrust the matter to the CBI for probe, they shall submit a report and then what is the Result.·                                                   Who is going to be benefited and or befitted out of such Reports?                  The Government or the victimized families or the activists who keep                Their eyes on such Reports run through their counter Intelligence System?·                                                   In the mean time, or by the time the Report is submitted, studied and recommended for implementation, if not at that place, region or the zone, some other attack, incident, or accident or of such sort, squarely opposite to the first one, in yet another mode, some activation or some type of attacks may take place, who is to answer for this, or to follow???·                                                   The Rule: 1: Boss is always correct, 2: if Boss is at wrong, and then follow Rule 3: follow Rule1 and say yes Boss. That is all. The activists may be named as Naxalites, Terrorists, and some other type of nominated names and their hand, like the ISI or some other version but the damage and destruction has happened without anybody’s knowledge?·                           For its aversion, who is to find fault with and to whom this can be attributed? To any Agency? ·                                       The name may be different, but the innocents lives are                   Lost, property whether belonging to the public or the                  Government is destroyed and shall have to be rebuilt or                 Repaired; ·                                       Under whose cost the expenditure is met; that is again                   from the public exchequer.·               As of now , the floods and cyclonic storms are given pretty good names encompassing some localized areas( this may to remember the date and the place etc., and mark out and feed into the Computers for the generations ahead to know of the happenings, etc.);·               In future even the attacks, accidents and the sort also may be given some or the other name, but with what results? What to be achieved?·               Former Honourable President of India, in the year 2006, while presenting COLOURS to the Railway Protection Force, advised the Government to evaluate a reasonable and workable single and unified Police Force for the safety and security of the passengers over Indian Railways duly expressing his views and suggestions on the working pattern and the present system of the Indian Railways - RPF (Railway Protection Force) and that of the GRP (the Government Railway Police of the States in India). ·               While the former (RPF) is under exclusive control and command of the Central Government, viz- the Ministry of Railways and non-else, the other (GRP) is run by different State Governments in their respective territories, that too District wise and also Police Circle jurisdiction wise.·               As of now, in the year 2010-2011, till date, nothing seems to have materialized, as the former Honourable President of India, thought; nothing happened so far. ·               50% of the expenditure over the Government Railway Police (GRP) on the Indian Railways System is borne by the Ministry of Railways; this in addition to accommodation, for GRP offices, and the Parade Ground,; some quota of earmarked railway quarters as per the GRP requirements; the supply of electricity and water follows; the Bills which might have been raised for realization from the State Governments may be with the Indian Railways for realizations, what results, some one has to investigate? ·               May be at one or other place there might be some thing like debates, or discussion for bringing a Law on the matter, but still it is found that the matter ‘The Safety and the Security of the passengers over Indian Railways’ is dueling and dialing between the RPF and the GRP; the Intelligence system is still as it was earlier.
                         NOTHING SHALL BE LIKE AN ENDPAPER!              Who shall initiate the result oriented action plan; ·                     The Ministry of Railways, or ·                     The Home Ministry or ·                     The State Governments? And/or;·                     Who shall come forward to bell the Cat, for this type of a New Security /Armed/ Police Force exclusively to work for the Indian Railways alone? ·                     Then, if it is so materialized by hook or cook, who shall take over the Force: A Million Dollar question? ·                     In whose hands the paramount and this type of sensational matter of making a single unified Indian Railways Police Force lie?·           Who shall review this without having personalized interests;                           May be- Other type of matters in their mind?
·   Once the RPF and GRP is MERGED AND MADE as a single Unified Indian Railway Police Force is formed, who shall deal on the matters like crime, Law and Order, and Intelligence over the Indian Railways System?                              Is it not true that the above factors and the formulations with differential equations and phenomenon are all correlated, clubbed and interlocked with that of the Intelligence System over the Indian Railway’s Functionary?·   Unlike the other CPMFs- Central Para Military Forces, and the CPOs- Central Police Forces, Why the RPF alone is separated, disintegrated with other Forces, and given full pledged and exclusive authority with powers and control on the matters like selection, promotion process; etc.? ·   Why the RPF is to be treated as such? Is it because, it is not a Police Force? Or ·   Is it because, it is exclusively under the control and command of the Ministry of Railways?·   Why it is not brought under direct purview, control and command of the Ministry of Home Affairs like other CPMFs/CPOs, like that of CISF-Central Industrial Security Force, BSF?·   Is it not true that the expenditure met for maintenance of the entire RPF over Indian Railways and also the expenditure of 50% of the amount spent on the GRP is through the sanctioned budget of the Ministry of Railways? In turn is it not from the Public Fund?·   What does it makes a difference ( to the rail-passengers) even if the RPF is made to work under the control and command of the Ministry of Home Affairs like that of the CISF?·   What does it makes a difference (to the passengers) even if the RPF and the GRP are merged and unified to make a single and unified Indian Railways Police Force and made to work under the control and command of the Ministry of Railways?
·   Just imagine and think retrospective, and prospective, with open mind and thought, for future of the Indian Railways; And of the RPF, the GRP, and the Passengers on the whole.; ·   Also compare with statistical figures, of the RPF and the GRP, and that of the CISF, right from the inception to till date, staring from the ranks and the growth of the two uniformed Central Armed Forces, viz- the RPF (under the control and command of the Ministry of Railways) and the CISF (Central Industrial Security Force) under the command and control of the Ministry of Home Affairs). Where does the RPF stand now? Almost where it was earlier? Of course, no one can question about the GRP, because it works independently with out taking a word from the Indian Railways, but only under the control and command of the State Governments;
                Of the CPOs/ CPMFs, the only Force, that is the RPF is vested with the powers of arrest, seizure, search, investigation, filing of charge sheet/complaint in the Courts of Law for certain offences falling within the meaning of Railway Property, and in other offences categorized under the Railways Act, etc…;             While all the other Forces working pattern are confined to the powers vested under the Criminal Procedure Code, like that of a citizen of India does, that is to say, the Forces like, BSF,or the CISF have to hand over the case to the Local/Area jurisdiction Police for further Legal action.            But, again, unlike the Police investigation, the RPF investigating officers are empowered to take up investigation under ‘judicial proceedings’ and that the statements recorded during investigation of a case including that of the accused persons and that of the witnesses are also admissible in the Courts of Law.               In what way or under what circumstance the RPF is inferior to the other CPOs/ CPMFs, or to that matter any Police working in the States in

, etc. They have already adjudicated as to be the best equipped and trained in the investigation process, Court’s dealings even up to the level of the Apex Court; Why then the Government is still hesitating to expand the powers under the IPC (Indian Penal Code) and other Laws, duly making it as a full-pledged single Police Force for the Indian Railways. Several of the RPF personnel from Group ’A’ Cadre, including Group ’C’ Cadre level are being inducted into other difficult jobs, like deputation to the CBI, Foreign Assigned Duties, etc. Evolution : Let the Government of India, even by making some type of amendments, etc, in the Constitution of India, or adapt some specific Law appertain and confining its application only to the Indian Railways system, HONOUR the views and imaginations of the Former President of India and evaluate to make a single Police Force for the safety and security of the rail-passengers and their belongings over the Indian Railways. Make out some action plan to abolish the dual power system by merging both the RPF and the GRP as one and a single uniformed police Force. After all, it is not aimed at some person, or group(s) of vested interests; it is aimed for the citizen’s of

India

and for the passengers, tourists, foreigners, who are traveling throughout the country over the Indian Railways, which is having a well established system. Let them feel free to travel with a hope and aspiration that their lives and the property are safe and secure in the hands of the Indian Railways Police Force. If the KING thinks to implement a matter, who/which can stop Him; it is not the proverb; · it is as much true, except that who shall come forward to propose, · expose the differences and difficulties of the two Forces, that is the RPF, run by the Central Government/the Ministry of Railways and NOT the Ministry of Home Affairs, and the other Force, the GRP, -Government Railway Police run by different State Governments, that too under different heads of IGs / DIGs of different states in India, and in some places, there stands no GRP but the L&O and Crime is managed and controlled by the concerned State’s District Police Forces itself and through District wise/Circle wise and so on.· With their fixed and pre fixed limitations on various aspects.· Try to abolish the differential/differentiation’s treatment and functioning aspects by making a single Uniformed Police Force of Railways.· As it stands now, the RPF found to be a separate entity by itself and not coming under the preview and/or purview of the CPOs working the command and control of the Ministry of Home Affairs.· In every matter of this nature YOU shall lead from FRONTLINE and not on/over the frontline without engulfing with some bindings and parameters to act, and initiative. Come out with open mind through FrontPage, ventilate inside stories of thoughts...· Let the public, the citizens and the passengers be made known about the passenger amenities, the consumer protection rights and privileges. Once a passenger purchases a ticket, he shall have to deemed to be insured in all respects...make out some more provisions on this matters...· Let YOU and the Editorial Board come forward, analyze to expose the PUBLIC VIEWS and thoughts; let you be the first person to enlarge and safeguard the interests of the passenger’s safety and security making as subject matter of interest by standing in the Forefront through Frontline of exposure to States; to the Central Government and to the public that no person like to die of his own and does not expect to travel to get some lakhs of rupees as compensation or some type of offer of compassionate appointment to their kit and kin, in lieu of their life, etc, etc,. · Let there may be some full stop for this type of activities; If this trend continues and not abated, a day shall come in future, in the present generation or in the future generation, that the activists take advantage of the weak minded persons,· the undesired and vexed minds try and they shall be injected with their formulations and ideals, and on one or other way, on one day or other, they may be successful in buying them at any cost, to play for them, like that of IPL matches now being played for a selective organization, while the others work as extra payers, off the ground.· This may ultimately spread like that of contagious dioceses like un-incurable cancer of final stage, without any remedy; herein future, they may work with their body’s for the sake of money and dare to do any action like that of suicide squads of other countries. There is no end for its working system; there is no defeat and no defeat is final unless you stop trying, as success never goes away from the personnel who are willing to continue the task, and achieve the goal; success never goes away from you unless you move away from it; stop making excuses, and explanations; be a team player in the Intelligence department. Alfred Sloan, the former Chief Executive Officer of The General Motors while dealing with management concepts remarked- ‘… I shall not tell you what to write, what to study, or what conclusions to come to. This is your task. My only instruction to you is to put down what you think is right as you see it. Do not worry about our reaction, and do not concern yourself with the compromises that might be needed to make your recommendations acceptable…..… There is not one executive in this company who does not know how to make every singly conceivable compromise without any help from you. But, he cannot make the right compromise unless you first tell him what right is….’For running an organization or an establishment like the Indian Railways, the administration shall have to depend on various aspects which shall include the Intelligence System. It should equip it, keep it under its control and administration and create a self contained Intelligence Net Work system of its own. There can be no exclamation if I prefer to add some of the remarks and news items pertaining to the working of the Intelligence Departments in the country:· Mr. Joginder Singh, IPS, former DG,RPF and also DG,CBI referring to combating terrorism and the leakage of information, observed that one of the main sources of all news (leakage)is the police itself( Spare Police The Rod- Rastriya Shara- December,2002);· Referring to the matters as to how the Intelligence departments’ information leaked out between the years 2000-2006, The Times Now News agency focused on 12-6-2007 through its Delhi correspondent Sri. S. Bhavathosh and views expressed in India’s Intelligence Agency Breached, What Malik, former Deputy Director, RAW(Research and Analysis Wing)who worked in the Wing for about five years know?· Laminating about the leakage of intelligence, Sri. Praveen Swami, of RAW viewed that with the defection of Mr. Rabinder Singh, a senior RAW officer, later turned to be a CIA agent during 2004 and with the arrest of S. S. Paul, a computer system operator of National Security Council, who was also known to the Indo-US Cyber Security Forum, the RAW has not learnt lessons. He also observed that facing an exodus of key personnel and increasingly vulnerable to penetration,

’s external intelligence service is beset by crisis. (The Hindu- July, the 5th, 2006- in Columns’ Half backed reforms at RAW).Now, coming over to the present Indian Railway’s Intelligence System, in the hands of the Railway Protection Force, the SIB-Special Intelligence Branch or the Special Wing, as it is termed is the main source for the Railways in collection and correlating the intelligence net work on the Railways. There might also be some more or other different State Governments and the Central Governments Machinery/Agencies who might be passing on the intelligence to the railway administration, but mainly, it is the RPF Intelligence department which takes care of the Railway department for collection, assimilation and dissimilation of intelligence. The present working of the Railway Protection Force, as an Armed Force of Union, it is not known if the RPF is also recognized as one of the CPMF, now may be one of Central Para Military Forces (CPMF), but independent of itself ,not working under the command and control of the Ministry of Home Affairs, and not equated at par with that of other Central Police Organizations, but ,still, it is not a Police Force of itself, have its own set of selection, seniority, rules and regulations, cadres and posts, promotions and transfers and for all purposes the Force have no linkage with any of the CPMFs or CPOs on these issues. The question and doubt arose is that whether the Railway Protection Force is in a position to cope up with the present trends of the challenges that the Railways are facing with its minimal personnel in the Intelligence department? I f yes! How much? How much of its pin pointed about the activities of subversive nature in advance and the names, if any, of the persons as sympathizers, or so for specified organizations against whom they keep a watch and surveillance. Industrialized area security system, tight Air Port or Dock Yard, Ports security, and providing security at a given barricaded areas is some thing else and is entirely different when compared to the working system of the Indian Railways. The aspect of safety and security of the Railways in particular and of the rail passengers, their belongings in general, is, inter-alia, inter linked with the Intelligence Department’s working system- which surpass inter-state-UTs boundaries at a stretch without having any trace of its movement to the rail passengers. Who shall take the Law and Order problem or to that fact about Crime control aspect over the Indian Railways System. How to find out the topography of the localities, hide outs and the places etc., unless one take a stock of every matter from the beginning to the end, which may leap for years. How much of the information is gathered about the subversive and other objectionable activities, organized groups working on the Railways which would be affecting the security and functioning of the railways has been brought out well in advance, other than the State Intelligence and other’s information and if so at what stage the security personnel could nab the activists or avert the sabotage, etc.The members of Force worked/working in the Special Intelligence Branch found to be not happy over the secret service fund, enormous and several lakhs of rupees expenditure shown to have been spent toward its utilization and doubted as to whether it has gone to the right persons and in the right direction was a point of doubt many express in darkness. On this issue, one may frown and get angry for all sort of this type of writings.
It is the time to shoulder higher and higher responsibility for smooth running of trains and its safety and security of rail passengers, and their belongings with least detentions. Intelligence department over the Railways should work like that of a ripcord. By shaking off the old and routine duties like covering the activities of the labour unions, etc., it shall work on and go ahead to penetrate into the others net work system to find out in advance which are the places, the sections of target of the terrorists, Maoists, etc., at one the name may change and turn out to look like some other thing ,but their actions and activities may be for one and the same target; they also to find out as to who are, if any, the persons associated in such activities. There can be no end for exploring, explaining and expanding the usage, the utility and application of the Intelligence Department in any systematized and organized industry, Ministry, etc, or as a matter of fact over the country itself. It all depends on the officers who are entrusted to work on such job. The working system depends on the personal interest shown by each individual and the training they were imparted, which include the I.Q., the Behavioral Sciences, and the body language which shall have to be clubbed with the Psychology. Without any reservation in mind, the Government shall have to think afresh on this issue in deep and resolve the intelligence working system over the Indian Railways. It is opined that the present Special Intelligence Branch or the Special Wing, the SIB, shall be separated from the present Executive Branch, and make it as an independent branch under a separate Director General, Railway Intelligence Bureau. This shall work directly under the control and ,command, supervision of Chairman, Railway Board, and the Ministry of Railways. It shall have its own personnel and pay scales and seniority. It shall have power and authority to draw officers on deputation from other police forces, etc. Let the great expectations of Dr. B. P. Shah, IPS, former Director General, RPF may come true. He observed that “... Railways are one of the vital sources of country’s integration. RPF being a part and parcel of the Railways, shares equally the responsibility for national integration by protecting railway properties and ensuring safety to the passengers, and the railway employees. The vast Force, numbering more than 70,000 is maintaining a constant vigil and displaying dedication and diligence to perform their task aiming at safeguarding the public interest...” (From the Desk of the Director General, RPF-‘Rail Sainik, RPF Newsletter and Magazine, Jan-June, 1993).

There are hundreds of honest and sincere politicians too in this country. ·                                 Honorable Union Minister Mr. P.Chidamabaram as back as in 1988,while inaugurating the second annual vigilance officer’s conference at Chennai said—‘the virus of corruption appeared to envelop the whole fabric of society and when some people tended to be corrupt, even the honest people became suspect’.( The Indian Express- Daily News Paper- Hyderabad Edition, dated 22ndMarch,1988).
   But for someone, not to blame all. Corrupt practice is not one man's job. Only thing to stop corruption is his own mind and firm decision making capacity to be honest. That is in my view personal desire as mother and the next is the father-the greed; none to be blamed except the person who is or was over powered with these two matters. Corruption is and always associated with white collar crimes which go hand to hand with gratitude, certain realities and externalities, they follow loyalties in the business of corruption; some scapegoats shall be in readiness to accept and go to any extent of sacrifices.·                                 Greed is innate and insidious; it is like apatite stimulator but works under gyroscopic machinery /personalities... The honest shall wait and wait time to pause/pass, only to Honor YOU with glory. Whether every year 'the 9th December' or the UNCAC are they not functioning to eradicate corruption... Still things going on, as usual... ·                                 All the personalities who value for corrupt practices and privileges with their power, authority, status, and the like does not yield to elders’ words to be honest. Engel’s words-‘it is self evident that where things and there inter relations are conceived, not as fixed, but as changing, their mental images, the ideas are like wise subject to change and transformation, as they are not encapsulated in rigid definitions, but are developed in their historical or logical process of formation…….’.·                                 The white collar criminality is found to be correlated and linked with the economic activity and advancement of science and technology, clubbed with the power and politics. It emerges on its own, carves and crop up through mismanagement, ignorance, over confidence, dependency, over reliability, uncalled for rewards, medals, praise, underlying assumptions, and so on.·                                 ·                                 It is a talk of the day in general that when news surface on some white collar criminality, every one denounce it and make hue and cry for strict action against the defaulters and so on. From the next day on wards they forget about the issues, and put their sight on some other matter of importance. ·                                 Its unabated trend as is emerging in all spheres of life under the guise of lacunae in the projection of evidence or through investigation loop holes. It is being protected and safeguarded by the vested interests during its official transactions for material or wrongful gains by way of inter dependence, and easy way of penetration into such agencies.·                                 These crimes are not generally located or identified by general public and even by others who have no access to the official dealings. SEAR·                                 Corruption weeding out:·                                 ·                                 Whoever may be the Head of the State-- President or the Prime Minister followed by others pledge to remain honest and to serve the nation with integrity, and what not.    But for someone, not to blame all. Corrupt practice is not one man's job. Only thing to stop corruption is his own mind and firm decision making capacity to be honest. That is in my view personal desire as mother and the next is the father-the greed; none to be blamed except the person who is or was over powered with these two matters. Corruption is and always associated with white collar crimes which go hand to hand with gratitude, certain realities and externalities, they follow loyalties in the business of corruption; some scapegoats shall be in readiness to accept and go to any extent of sacrifices.·                                 Greed is innate and insidious; it is like apatite stimulator but works under gyroscopic machinery /personalities... The honest shall wait and wait time to pause/pass, only to Honor YOU with glory. Whether every year 'the 9th December' or the UNCAC are they not functioning to eradicate corruption... Still things going on, as usual... ·                                 All the personalities who value for corrupt practices and privileges with their power, authority, status, and the like does not yield to elders’ words to be honest. It emerges on its own, carves and crop up through mismanagement, ignorance, over confidence, dependency, over reliability, uncalled for rewards, medals, praise, underlying assumptions, and so on.·                                 ·                                 It is a talk of the day in general that when news surface on some white collar criminality, every one denounce it and make hue and cry for strict action against the defaulters and so on. From the next day on wards they forget about the issues, and put their sight on some other matter of importance. ·                                 Its unabated trend as is emerging in all spheres of life under the guise of lacunae in the projection of evidence or through investigation loop holes. It is being protected and safeguarded by the vested interests during its official transactions for material or wrongful gains by way of inter dependence, and easy way of penetration into such agencies.·                                 These crimes are not generally located or identified by general public and even by others who have no access to the official dealings. OLD AGE – A BOOM AS A BLESSING OR A DOOM-VIVEKASADHANA-A POINT OF VIEW.I have made out this Article, for kind perusal and publication in your esteemed Journals, if deemed fit and proper. Most Obliged. I am writing this ARTICLE not aiming about any person(s), but from the feelings expressed by several intellectuals, old aged senior citizens with whom I happened to converse and from whom I could gather the information about their inner hearts. The annotations, captions at some places used, does not necessarily be construed or to be applied to any person(s) or to their (our) families; it is expressed to reflect and praise the MOTHERS who happen to face such agony, etc.)   <><><><><><><><><>><><><><><><><><><><><><><><><>There is a saying--" Those who knows the mother, knows the world”. This caption might be true. But, ironically, he who does not care for the mother at least at the old age when she really require and expects actual help and assistance from his son…..what to call him…How to define him and in which language…Just think and imagine the feelings of old aged persons of and above the age group of 50-60 years, who happens to live separately or away from their son(s) and of course the daughters, already married and always stay away with the parents... This may happen on various accounts like:·                    By virtue of their son living on account of job in some other state or country;·                    Or in the course of living away from them though staying in the same city but living on account of their jobs, children’s education, or to be nearer to the place of working;·                    may be in the course of love marriages; and ·                    May be on one or other account or pretext.

In general, it is found that they are not in a position to talk to their parents--,in particular with his mother; they find no time to visit to the mother’s house, if they stay in the same city, even during holidays, festivals or other festivities, at least to say hello, or to spend a little time to have consonance their aged parents, and to be in particular to the mother. Their offerings of excuses include heavy and unbearable job work, over time, late sittings at job work, or that they are not in a position to spare time to come from their place of residence, or other wise engaged, preoccupied on some other work. It may be heartening to hear from others that the so called son and his family members were seen at the restaurants, hotels, or at cinema halls, market places, or at the busy malls etc. The comments of the neighborhood, the relations, and of the friends at this old age found to be unbearable to them. The mother, or of course, the father, make out all sorts of excuses and explanations by supporting their son’s absence. But, the mental agony of the parents, their untold feelings, sleepless nights are and cannot be brought out through pen. Their swallowing of the expressions to cover up their inner feelings, the Atmaxobha and eyes always searching for their son and to listen to him are all found be a like their nightmare. The enormous money they possess, the relations they had, the friends, the authority, the power and the status they had, all have found to be not coming to their rescue in replacing the sons’ presence with them. The old age homes, other’s counseling’s, etc, will they be of any help to them from making them to feel happy or to come out of their depressions, which I found that no person can recognize, replace , establish or detect.   Try to read with patience, in between the lines and not with severance or in hasty. Sadhana for Elation and Elevation is found to be the only solution for the mothers who are neglected and made alone to live by their sons. No smothering words can help in distracting their eyes eagerly looking at the gate side, ears wanting to hear his voice of affection and love. But, but, but… what. ----what the sin she might have committed to loose all this love and affection from the son? What to write and how to console and convince her about the present position of her son, and his re-thinking of inbuilt imaginations and thoughts; redefining the works, words to suit to his conveniences. These revelations may be with a view to satisfy his wife alone at his cost of life, only to make her believe that he is taking full care, love and affection towards her/his wife. Or his not visiting his mother may also be to make her/his wife believe that he does not care his mother, father , other relations, and that he tries to make her believe that her/his wife’s versions as true and beyond doubt. How to change his mind set up and about misconceptions toward the divine mother. Many of the people advocate the golden means saying that self effort and fate are like the two wheels of a chariot or are like a pair of scissors. Whenever defeat stares us in the face, we try to console ourselves by ascribing the failure to our ‘stars’, to predestination or to the result of our deeds in the past lives. Whatever may be their philosophical connotation, there can be no denying the fact that we ourselves must strive to elevate our lives. We always adjust to the life’s spring and actions. We must bravely march forward. We must work with a sense of dedication with immense faith in our self-effort.
There is a saying to the effect that up to the sixth step it is human Endeavour and the seventh is divine favour. Has anyone in the world ever risen in life without sustained hard work backed by assiduousness and enthusiasm?      Can we ever be successful in any field of life if we idle away our life waiting for fate or fortune? Such a mentality will convert the man into a coward and a slave to sluggishness. People commit many mistakes due to their weakness and then put the blame on the stars, fate and luck. It is said that a man who slipped carelessly and fell down blamed the fate and the ground for his fall. Be realistic to understand the situations, the consequences and the sequences that might have erupted from the beginning to the point of separation of lives- in this context- of the mother and the son. Just pity the mother, the son also, and for the matters encountered in her life and of the dreams about and on the expectations of him she had. Imagine the stamina and the strength she had to sustain the draw backs, the push backs in her life to bring her son to the present position. The kicks of her son on the chest received during the early age as a kid and the joy she might have felt at that age. And now when her son grew with maturity, in mind and developed his own thought revelations and the actions with self decision making to select and marry his life partner, reside separately and away from the mother, what explanations can any one put before her. Her reconciliations from his child hood, she, as mother, might have pondered with joy and jubilations for the first actions of the son, receiving kicks on her chest, and now for the second actions. Who can imagine her feelings and rethinking of the past which are entirely different to her expectations? She might have become a soft target to her belief or he might have become simpleton? He was rather a hot stuff with sanguine this affair…? Is he became sandpaper or a sandwich in his life and with the life of his mother in the name and style of living separately on one or the other pretext with his family? Is it due to the love and over helmed affection and sympathy towards his family? Or he has adapted to suit to his convenience to visit the mother and satisfy his other loved ones. With all the above regurgitates and surmises, still I have a belief that he is a person with sanity and still did not loose love and affection toward his mother, then why and how the situations can be changed and what is the solution to resolve the matter. I have no answer, except to rely on the God.      Even if we concede that there is fate that hinders us from reaching our chosen goals, still we can overcome the fate through our diligence and also by awakening our spiritual strength. Had there been an omnipotent fate, concepts lie fair and foul, virtues and vices, spiritual strength would have been unheard of. Human beings are not a mere sod of earth or a log of dead wood. No one can ever prosper in life if they harbours the feeling that they are not responsible for their actions, that it is the fate which makes them behave as they does and that they are pushed and pulled helplessly by fate. He who blindly follows the invisible fate is propelled by extreme ignorance which cannot but precipitates his downfall. I firmly believe that only he who surrenders himself at God’s feet and prays to God whole-heartedly can regard himself as a machine and God as the driving force. Especially noteworthy is the fact that such an individual can do no wrong and can do no harm to others. This great man will be an embodiment of selflessness always aspiring for the weal and welfare of all in the world.             I boldly and with pride ascribe these connotations to the mother, who might have faced and or facing the wrath and the sufferings of the life, that too without even whispering to others. But, now, at this age, when she requires a helping hand and counseling – the same is missing from her son. Fortune favours the deserving…: Patience pays….But. At what stage? Will it be of any help to her when she can not be in a position to relish, realize, and understand the same, except staring at him and dump founded by the actions of his son? The GOD - the almighty only should help the Mother and resolve, if He can. You are nothing whereas God is everything.

The white collar crime generates through super derogated official actions concerning to an issue or project, and emanate at a particular time. At least one official is always involved in enumerating for its emergence through ante room. It is not that easy to read the minds of these officials, unless you join them, (at least as a decoy, and or act as a secret agent or dope), It is very difficult to find out the plan of initiation and action before it is worked out. It is a recognized arrangement and or an agreement between the vested interests; of course one should have high social standards, respect, domain, status and what not.

Once the operation begin, they shall not have time to re generate to think of its side effects as the material or wrongful gain pour in and they are caught in a vicious circle.
Is there any remedy or resolution to solve the problem of white collar criminality? Certainly, one can say yes. There should be a favourable and positive answer.
Of course, the crime and disorders in the society attract the Law and the Law enforcement agencies. But what about the white collar crime, which is independent of itself.
The authority in power has to analyse as to how and why it is living and surviving from within itself, and why it is even withstanding the pressures of the society; why the Law enforcement agencies are unable to tackle it effectively and efficiently; why it is grooming forward with out any sudden death or ineffectiveness. For all these questions and problems, sincere and honest answers are its solution.

It is my opinion to select sincere, good, and efficient personalities from all fields including the public and private industries; make coordinated committees; the chartered accountants, the doctors, the engineers, the bank officials are the officials who can also lay hand and curb this menace at the beginning. There shall be a separate department by itself.
The Intelligence departments and other co related Vigilance branches of the Central Government and of the States, the Economic Offences Wing, the Customs and Central Excise Intelligence wings the Narcotic and Drugs control wings are some of the citations which are dealing with the specific nature of offences. Making exception of the Honourable President and the Prime Minister all political and others including the Chief Ministers shall have to be brought and be dealt severely under the Lokpal provisions. In this context, one shall not forget the speech of the former Honorable President of India's words and vision spelt very clearly while presenting President's Colours to the RPF in the year 2006.
( Former) Honourable President of India Dr. A. P.J. Abdul Kalam has presented the Presidential Colours to the Railway Protection Force on 22nd May, 2006 with certain observations and suggestions to the RPF / the Government of India, the Ministry of Railways, the Railway Board, New Delhi, to make rail journey safer and secure to the 12 million people including the tourists who are making use of the rail services every day. The Hon’ble President reiterated:(1) the need to remove the division of responsibility between the Government Railway Police (GRP) and Railway Protection Force (RPF);(2) for empowering the RPF with legal powers to tackle all cognizable offences under the Indian Penal Code (IPC) and Special Acts so that there is a single point of responsibility for tackling crimes against railway passengers. Even three decades earlier and thereafter also there were lot of dialogue and paper work on the matter. But, nothing materialized. There shall be a day to celebrate over the Railway's System when there can be only one Police Force and not TWO as we see today- the RPF and the GRP- both work independently and separately under two different heads and one work as per State Governments orders and the other as per Ministry of Railways orders. When one can see the reality keeping aside all the types of privileges and what not???
These are supplemental to bring down the economic offences where on Railways or in any part of the other Ministrys and sister departments.. But, it is opined that they can not eradicate the so called white collar crimes which take its bud from within and emerges surreptitiously unless curbed at the beginning itself.
It is opined that by a special Act or other wise, there shall be a separate department at the Centre under the exclusive control and supervision of its Chairman and the Chief Director General and he shall be answerable to the Parliament and to submit annual report.
Like in the IPS officers’ cadre transfers, seniority and promotions, the personnel from one Force shall be subjected to transfer to the other Force, so that there can be no ambiguity in their seniority and promotions, being centralized services in

As seen from the present set up there are many a number of Armed Forces- some working under the exclusively control and command of different Ministries of the Central Government, like the Ministry of Home Affairs, the Ministry of Railways, the Ministry of Defence, having there own set up of selection process and procedure, transfers, seniority, and promotional channel.
Unlike that of The Railway Protection Force, it is believed that in India there is no other Force having only two types of group cadre posts-Group ’C’ and Group ’A’. There is no system of other channel of promotion, a Group ’C’ cadre post personnel, like the Inspector, shall be promoted directly to the Group ‘A’ cadre post as Asst. Commandant/Asst.Security Commissioner and the next promotion for him within three years of time is Commandant. While in some other Forces, in between the posts of Asst.Commandant, there lies another post like Dy. Commandant and to get the promotion to the rank of Commandant many have to wait and see for some vacancies and the like. But in the RPF, on one or the other way they shall be promoted to the rank of Commandant just by completion of three years of service and not even five years as is envisaged in their Rules, they say. Probably, they might have taken up the Force Personnel-having completed three years of service at par and equal to that of the other Railway Cadre officers for whom there might be some other set of codified Rules and Procedure excluding the RPF, being a Uniformed Armed Force of the Union... This aspect of my view may be wrong.
Like all other Central Government Forces, the RPF shall also be brought under the control and command of the Ministry of Home Affairs. There still lies a feeling in most of the personnel that having given the Railway privileges and the sort being in the Railways and working under the command and control of the Ministry of Railways, and if they are taken over by the Ministry of Home Affairs, they shall have to loose all the privileges and other type of facilities being offered by the Railways, and hence they are found to be not inclined to make out any proposal for getting the Police Powers and responsibilities like other Police Forces and there by replace the GRP from the Railways once for all. It is opined that this type of fear complex, in my opinion, is and has brought down the image of the Force to many ways and is being continued as it was without any Police Powers. It is believed that who ever may be and as a matter of fact, any official working on deputation over the Railway System shall be entitled with all the facilities and privileges as enjoined by the Railway men. All the central police forces and other armed forces like the RPF shall be brought under the command and control of the Chairman and Chief Director General of the Central Police Organization under the Ministry of Home Affairs. There shall be only one type of selection process, procedure. The Rules and Regulations, and the departmental proceedings shall be same for all the Forces personnel whether working in the States or under the Central Government services or at nominated public undertakings.
There shall be a separate Central Intelligence Wing exclusively to deal with white collar crimes under the Ministry of Home Affairs. Like the Central Bureau of Investigation, or the Intelligence Bureau, it shall pass on the forecast and the intelligence to the Director General for its evaluation and further process to eliminate black sheep’s from the concerned departments.
The incumbents shall be drawn by an honest selection process. Qualitative selection shall be the need of the hour to curb the white collar crimes.
The Central and the State Service Selection Boards or the Committees shall be under one command with one and similar type of centralized selection process, in so far as the selection of police or other subsidiary forces selections takes place—whether for the CPOs, or the CISF, or RPF.. All shall be treated alike…; there shall no differentiation between the ranks, cadres or groups, promotional prospects, ad -hoc continuity( the best method adopted by the Bureaucracy at least in RPF as a weapon against the departmental promotees for over five decades and still continuing without treating at par with that of the direct Group’A’ Cadre/ClassI post officers, DAR Rules, etc… from one Force to the other one; whether it may be working for the State or for the Central Government.

When somebody has withdrawn from you, that's how you feel about it. Now, if you have been abandoned, then you can regroup once again, and you recover some lost and neglected persons. And you rebuild yourself in a new adaptation, essentially.

Now, everybody in this world has been abandoned many times in many ways. It was dramatic, obviously, and probably not real common. But it symbolizes a feeling -- a feeling that many people in our world have, which is that somehow or another, somebody walked out on them. And there's two ways that happened. One is physical: the person walks out physically. And the other is emotional: the person shuts down their doors for them emotionally, even while they're still there. In either case, the heart sees it as the same. It's abandonment. The third and the most important is that we may even for assumption sake, shall think that we ABANDON ( in MIND) some person, what ever may be the cause or the reason, but still. We can not just loose sight of him or of his thoughts and his or her emotional attachments which you had earlier, may be of this life or the earlier, still , you shall not forget them in soul and in mind; lest you may abandon outwardly and try always to avoid them.

You could've had a parent who was really enthused about you at some point in your development, and then sort of lost enthusiasm, for example. Or you could have had a lover who did the same. Or you could have had a friend in high school. You could have had experiences in the world. The world, you see, is like this. In the world, it is not uncommon that such things would happen in the life of someone, and for anyone.

And therefore, you go into the adaptive cycle subsequent to abandonment, in which you rebuild yourself in a more conservative form. Your revised mentality is supposed to be in some ways wiser, and in that respect healthier.

However, we do have an expression called "damaged goods/ the respect or the insult". And when we speak of damage, we are not speaking of health. In fact, we are speaking of unhealthy atmosphere of some one who was abandoned, and the person who abandoned. We shall always be trying to search or research for something which makes you compensate and compromise your mindset and the mood condition of compromised and diminished well-being of each other-- Damaged goods/minds of actions in retrospective and without prospective and positive thoughts...

And then we have an expression called "emotional baggage." When we speak of emotional baggage, we are not talking about a healthy and wiser adaptation, which is the one that we think we're building. We think we're wisely revising to a more "realistic" perspective, “Improved goods” without retrospective or going for positive thinking trying to be compromised for the realities of life. But we're having and preserving the damaged goods as we adapt such thoughts through our own mind-perversions and with out realities and realization, even after the incident. You can name it any way you want, but a rose is a rose by any name. And damaged goods/minds are damaged/minds, unless you rebuild them, there lies the positive thinking and the give and take policy of forgiveness and forethought.

So that non-revision of attitude and social orientation, which characterizes the average person's world experience, is a downgrading towards a closed heart from a relatively open condition. And this happens stepwise -- steps down towards more and more damage on the goods. The progressive achievement of "wisdom" and "realism" which is a progressive achievement is compressed and suppressed with a version of closure in the heart.

And so we say we are wiser and healthier, but this expression "damaged goods/minds" shows we are not better off having made these successive improvements or adjustments and adaptations. We are certainly worse off. We are damaged goods; we are less open in mind as well in action. We are less free. We are less human in every way. Because we are less inclined to wear our heart on our sleeve, which is an expression for being real. In other words, "I wear my heart on my sleeve" means I present myself as I am; I do not hide my feelings. Now, if in fact, if I do not wear my heart on my sleeve, then I am less human.

And so, we move from this heartbreak to heart brake, b-r-a-k-e. Heartbreak becomes heart brake. We have brakes on the heart. We have brakes on our feelings; we have brakes on our humanness. We have brakes, braking action. We withhold on that level. We confine and still continue ourselves to our thoughts and feelings and do not care for other’s thinking and so on.

This movement or adjustment is creating a world that is unified, in their circumference and circumstances confining themselves to their reasoning and imaginations about others. In that every person is affecting every other person by their adaptation.

They're all going solo, observe the pronunciation and do not adapt it. That's s-o- l-o-w. They're all going so low with their new adaptation of damaged goods, into what we would call distrust. This eventually disturb the peaceful mind and drag to ward unwarranted thoughts and imaginations and into being guarded, withholding, withdrawn. Not wearing our heart on our sleeve, but instead being duplicitous, unavailable, anti-juicy, anti-good, and pro-selfish. This situation is nothing but Pro-self-protective. This is the nature of the damage upon the goods that we are.

And it is a global damage that we experience as humanity, which we experience as each other. This is nothing but, Self Damage and also Damage to others. We experience the strategies of damaged people who see these developments as wise, as bringing themselves up to speed with survivalists and proper, appropriate adjustment of their attitude.

So the people we meet are all already wise. They are all like us, but they have reached so low. Before we arrived to that state, stage, they have reached it, already, all ready. They were ready before we came, for our arrival. They were waiting for the guest. They prepared for the guest by shutting down their heart, by keeping themselves under lock and key, by presenting us with a facade that is impervious.

If we too, ourselves are already similarly wise, similarly well-prepared for life, similarly realistic and so forth as above, and not realistic in mind and thought-- whatever we want to call these things, this is closed condition -- then what we have in the ensuing meeting, when we meet that person who is prepared and we are also prepared, what we have is a grand mutual irrelevance. At least we hope it is that; we both hope that, individually and mutually we shall not respect each other and even if other is in changing mind with positive attitude toward YOU, you wantonly discard him. In your thinking and preparedness, you must be irrelevant to them, and think as if to make them believe that your actions are for them to be safe. And, reciprocal in action, you always like that they must be irrelevant to you for you to be safe. Or your relevance to them must be minimized by them, and their relevance to you must be minimized or held in check by you, to be safe. And that's what: heart brake.

They will do their best to minimize the extent to which they give you their heart, in negative terms and conditions, to protect themselves from you and from relationship and its presumed dangers, and damages. And you will do the same. And this is the non-event of your relationship.

It is a world of hurt people with a huge heap of hurt, a mountain of pain, a pile of pain, in the hearts of both the persons, but none shall come forward to reunite. It's your world. And they see your pain. And so they see a heap of hurt, a pile of pain. And they see it in the world everywhere around them, as you see it in the world everywhere around you. And so they have gone so low, maintaining irrelevance in their lives. They are heart sick indeed, and therefore withheld, sick in the heart, sick in the love department. And, they are all going solo, all going so low, to survive, individually, feeling insecure and circling as moving in “No- safe Zone”.

So the world they're seeing in going so low is the world they're creating them selves and visualizing as of real. Let you leave the matter to the God and also the persons you in fact does not like or dislike and even hate heart in heart, but still you as a human being wish them to be good and try not to discard them and express friendliness and love, Let them realize this or not!

Now, when we say ‘For God forsaken', ‘heart braking', which means to go against the natural tendencies that God implanted in the soul, which is to love freely and spontaneously and generously. Trying always and in all-ways preparing to put ourselves the brakes on such matters. To become the kind of person we want to be --a self-protective person, a selfish person. To create that kind of person we put the brake on the heart. That thing in the middle here is a disc brake, for those of you that are not mechanically inclined. It's a heart brake.

So now you see a world of heart brake in every sense. A systematic withholding from you your self, that is from your inner thoughts, duly suppressing and controlling them, which has, in fact, broken your heart, and caused you to put on your heart brakes. Because if you do what they did, which you almost certainly will do so, as a selfish, emotional and egotistical person, then you will put on your heart brake in relationship to them. You will work to maintain their irrelevance to you. And you will break their heart in the process.

And they will then put on their heart brakes a little more. And so they will, then, reject, or withhold from you, and break the heart of you, and/or disappoint someone else. And who is that someone else? Exactly who that someone else is? That is the person you are going to meet and try to get together with. But because of you, it will be too late! They are ruined, by you through your other friend, the one you rejected, who then rejected them, in turn.

The present system of working in any industry by any professional or for that reason any personnel is to get more and more perks and they are in fact found to be least bothered or interested to find out the ways and means to apply their awareness and mind to bring growth to the organization by which they are employed.

What ever their level of the management cadre, they first think of their purse and take home salary and other ways and means to come closer to the boss and as to how to get higher and higher positions or promotions.

For this type, they tend to express their work capabilities and workmanship only to that extent and till such time they get higher perks and upgraded with higher position. Their aim is found to be to work with such and such organization/s for such period say around 4-5 years and get themselves recognized or organize their know how on their professional matters of interest and look for the right time to jump over to any other organization for extra perks and elevation which may include, a chance to serve in other countries and so on.

At this point of juncture itself the organizations security and inside story is becoming as the target and how much of the matters are discussed out side the office hours as gossip is not taken care of by the management or its managers. They feel that it is a matter of routine in nature. That is all. There the actual story of intelligence matters are leaked out or the security aspect, management weakness, exposure are coining out. May the information talked about is of any importance or not, the same is openly discussed, including that of the boss/heads of the departments, other weakness, their family history, and the people’s movements. The security personnel and their subordinate’s words who have been employed are not taken into confidence by the management, or the board of directors, as their presence and suggestions or the advice on security aspects, which include the intelligence gathered on the industry’s physical and or on personnel working patterns and so on… But they are asked not to open up their minds unless they ask to do so, and even if they ventilate their news about some personnel, it was just ignored and at times, the person was asked to be careful as he is being watched. There may be some differential equations between the working system and security deployment between the Central/State Governmental Organizations and the private/or the public sector organizations. But in most of the systems, the internal, physical security of men and materials and that of the organization’s safety and security is a matter of concern. In these days of competitive intelligence hangovers and economic or industrial bypassing and awaiting a chance for take-over, the security systems and services are found to be playing a vital role under ground even with out the knowledge of the management and they are not leak proof.

Insiders or to that matter, the family members, are the most targeted persons by the opponents, who are outwardly and in open terms seems to be the best coordinators, or the partners in all matters. Industrial or education tours, visits by important persons accompanied by un known persons at specific intervals is the most watch dog situation for an industry who have not adopted to utilize the sophisticated intelligence trained security personnel. Physical security of men, material, and that of the industry is very much important, but it is also very much essential to get good intelligence officers, whose integrity shall be tested by reputation and not by the medals, ranks, status, position, and other rewards. The overt and the covert acts of the insiders and also the outsiders-visiting the organizations on one or the pretext or for the expansion, business deals, research scholars, celebrities, and the like are the soft persons through whom the matters are leaked out. This type of intelligence system working is not for material gain, but aimed to find out the ways and means to get the loop holes to be used in future course or when time permits and bounce upon for its merger, closure, etc. Even at these junctures, the security services, and the personnel utilized are of no use to the organization, as they are useful for nothing and not meant or trained for such activities. This is at times used as competitive intelligence network through individuals or group of highly placed persons, against whom the lower or middle management security personnel have no approach to them. That is the weakness of the organization, which had no fore thought on such developments. Gathering information/intelligence is an Art- a systemized way of approach of the weak minded or the persons on some need-or who are can be pinned down for the three Ws-wealth, wine and women or of such natured Art cannot be equated with any matter of procedural practices, which can be just trained and adopted by specialized personnel alone, who are being utilized by the other organizations, even who/they might of in friendly nature, including partners?

No organization, to my knowledge and belief is found to have specially employed any such security system personnel who are being utilized for collection of intelligence, assimilation or dissemination on matters of security system of its organizational set up so far. These include systemized installation and monitoring of the equipments and so on.

In intelligence gathering on what ever subject or matter, there can be no legal or illegal means which are designed to be adopted or not to be adopted. The matters depend on the organizational set up of standards, its status, economic, and on competitiveness over national or international systems. All the matters depend upon the situation and the person on whom they are going to be taped or tapped.

it is not to be misunderstood as trapped, before tapping, they find out all types of information, weakness, rigidity, and the religious background, disgruntled or dissatisfied personnel, susceptible to or not, but they sanitize the matters and adopt suitable forms to suit to the situation of adoptability, etc.

Espionage, sabotage, other types of criminal activities shall not be clubbed with the security and intelligence working as they are to be dealt separately and independently like counter intelligence, surveillance, counter espionage, cyber crimes, white collar crimes, etc shall have to be dealt separately even though they may overlap or inter related in terms and working aspect.

Economic imbalance, auditors reports, taxes, customs, tenders, in fights for power and authority, trade union activities, for and/or against the management, logistics--adjustments, or theft of materials, machinery failures, present trends of contract/outsourcing systems-- of personnel, drivers, cabs, are some of the fields where they might be interest and a tool for targeting its down fall, or surrender to others, etc.

In this aspect one has no say on the white collar criminals of the organization’s-insiders who adopt, or opt for wrongful gain, and having become easy to contributory or compromiser’s formulae with others and such person’s identity and exposure may become a problematic issue which may ultimately reflect on its working aspect itself.

This may lead to lot of panic in the heads of the departments, chair-person and the CMD/or MDs and weeding out such personnel is a gigantic task with out getting the matter leaked out.

It was brought that most of the companies now a days without employing their own security personnel, may lead to have rights and privileges at par with that of other employees, and to cut short all these matters leaning toward engaging the security services on contract or outsourcing basis.

Herein, it was also informed that the organizational heads are leaning toward white collar criminality through wicked minded contractors or the outsourcing agencies for their wrongful gain. They found to be adopting various dubious methods.

The contractor or outsourcing agencies show on record such and such number of security personnel but actually engage only one third or even less staff and the amounts they such receive shall be shared with the company’s head and others connected. They do not even maintain proper record about their provident fund account or the employee’s state insurance or health cards.

If any of the employee make hue and cry on his PF returns and repayments organizations by showing different names.

It was told that if the company’s dealers are still greedy, they may even create some non exiting contractors or the outsourcing agencies, make out some other records to show that the security guards were deployed in their organization for some period and get their payments passed and en cashed. In such cases, they informed that there shall be contract agreements, quotations, no news paper quotes.

If the company’s interests run through in organizing their interests through some fictions outsourcing agencies, they select interested parties who make out all the formalities on some names, which might have been existing, or non existing persons or companies, and formulate their signatures as of the outsourcing agency., the same shall be arranged on vicious names. It was also brought that the same guards are rotated in shifts at two or three different companies or

There was a news item published in the Hindu daily news paper dated 13^th Jan, 2011, Hyderabad edition, at page 5 about the Hyderabad City Police to regulate private security system by making an enactment to control and to have a check on private security Forces/Services, which may be ‘five times the police force’ strength in the State. It may not be out of place to doubt as to whether the Police have any official record with full details of each and every such Agencies now running even over and above the Police/Central Police Organizations in the State and also in the Private and Public Sectors which shall include the Railways, the Educational Institutions and the like. .

In this connection, may I take opportunity once again to state that there exist already a Law --“The Private Security agencies (Regulation) Act, 2005”, on the matter and that in my considered opinion , the State Government has to take appropriate action to implement the same in stricto sense. In this Act, there are several laid down Rules and regulations about the recruitment, training, registration of the Firms/Companies dealing with the Private Security Systems.

In the present context of safety and security which shall, also include the Intelligence System of the Organization, what so ever, for which the Government or the so called Private Security Forces deployed or employed. Keeping in view of infiltrations and the sort, it is very much essential to have a proper and strict Regulatory Body to control and have command on the ‘five times the police force’ strength in the State.

In these stories (of white collar crimes) - very interestingly lean around and you can imagine and know as to how the criminals keep watching on others, move in groups, follow up actions, exchange know how and intelligence, travel in long distance trains with out any distraction, phlegmatic, and with out raising any suspicion or doubt; as to how they listen to the conversations of the passengers, relatives during send off, or in the train etc,…..

Alfred Sloan, the former Chief Executive Officer of the General Motors while dealing with management concepts remarked- ‘… I shall not tell you what to write, what to study, or what conclusions to come to. This is your task. My only instruction to you is to put down what you think is right as you see it. Do not worry about our reaction, and do not concern yourself with the compromises that might be needed to make your recommendations acceptable. There is not one executive in this company who does not know how to make every singly conceivable compromise without any help from you. But, he cannot make the right compromise unless you first tell him what right is….’

For running an organization or an establishment the administration shall have to depend on various aspects which shall include the Intelligence System. It should equip it, keep it under its control, command, and administration and create a self contained Intelligence Net Work system of its own.

Dr. B.P.Shah, IPS, former Director General, RPF may come true. He observed that “... Railways are one of the vital sources of country’s integration. RPF being a part and parcel of the Railways, shares equally the responsibility for national integration by protecting railway properties and ensuring safety to the passengers, and the railway employees. The vast Force, numbering more than 70,000 is maintaining a constant vigil and displaying dedication and diligence to perform their task aiming at safeguarding the public interest...” (From the Desk of the Director General, RPF-‘Rail Sainik, RPF Newsletter and Magazine, Jan-June, 1993).

M. O. Mathai, Mr. Jawaharlal Nehru’s Special Assistant, in his Book “ Reminiscences of the Nehru Age” quoted “ all politicians are like squirrels… and that no mater how old the squirrel is, it will never give up climbing.” I am of the opinion that these words are found to be equally suited to the white collar crimes and to its perceptual.

Sutherland, as back as in 1940s, is found to be changing its trend ,fashion and bounds. It was termed to mean ” approximately a crime committed by a person of respectability and high social status in the course of his legitimate occupation”.

In its 47th Report, the Law Commission termed it as” a crime which is committed in the course of once occupation by a member of the upper class of society”.

Honorable Union Minister, Mr. P.Chidamabaram as back as in 1988,while inaugurating the second annual vigilance officer’s conference at Chennai said—‘the virus of corruption appeared to envelop the whole fabric of society and when some people tended to be corrupt, even the honest people became suspect’.( The Indian Express- Daily News Paper- Hyderabad Edition, dated 22^nd March,1988).

The age old proverb continues to be up spring—“while honesty knock and waits at the door, the bribery enters in...”

It was said that any ruffian can defy the boss, the prince with impunity, and an imbecile in power sacks worthy men also if they dislikes or get them out of their division/or the zone. They also whisper that the power politics with in the department prevail. They grumble to the extent that ‘A cur that prefers to bite a shoe does not know the taste of sugar cane’.
